Power of Attorney holder for NRI
Hello:
I looked around the forums but could not quite figure out the answer.
My brother recently became an American citizen through naturalization. He has applied but not received his OCI card.
Now, we are in the middle of litigation and need papers from the local municipality regarding his property in India (property was purchased 20 years ago when he was residing in India, no challenge as to legality of ownership).
We have been advised to seek release of the documents under RTI since the municipality has been behaving like an ass and not responding to repeated requests.
Can my mother, who is an Indian citizen residing in India, ask for the papers using her Power of Attorney? Or does the grantor of the POA have to be an Indian citizen (or OCI) as well before the POA holder can ask for information under the act?

Under the RTI Act, any citizen of India can ask for information.
He/She need not have a POA of anyone.
Your mother or you or anyone else can apply for information to the municipal corporation.
Overseas Citizens of India (OCI's) and Persons of Indian Origin (PIO's) Card holders can also apply for information under the RTI Act under their own names.

Mr Karira, will it be convenient for you to give/quote ref. of above rules/regulations where people "not ordinary Indian citizens", like OCIs and PIOs ,are permitted to seek information under RTI Act under their own names.
This is to clear my doubt ,because recently in my reply to one of the posts I had said its not permitted.
My logic/reason being ,the Constitution of India does not permit dual citizenship ,therefore to have Indian citizenship,one has to be eligible/should have Indian passport.And OCIs and/or PIOs,being holders of foreign passports are not permitted that
