Want to know time duration of Appeal and First Appeal
Any one can tell me, i have submitted my RTI to officer. But she didn't reply me withing 30 days. Now i want to submit my FIRST Appeal to the Appeal Officer. But I do not know, under how many days I should submit that form to the concern officer?
Pls tell me as early as possible. I have applied on 16/06/08. Today 30 days are over.

30 days of receipt of your complaint directly in the concerned office/department.Sponsorer
35 days.In case the information is from other office/branch.(other then the office where you have originally submitted the application.)
In case of Post then days will start from the date of delivery.
It is advisable to wait for total 45 days(30+5+10 postal delays) after waiting for 45 days you can file your Ist appeal before the Higher Authority/Designated Authority/Appelant Authority of the concerned department.

Thanks.
I had filed an application under RTI Act with Kanpur Nagar Nigam for information regarding road repairs etc on Dec 10, 2008. I have received a reply on January 17 that they need 25 more days time to reply since information required is exhaustive.
Do I need to remind them or should file my first appeal. I think there has been a lapse, since more than 30 days period expired on February 12, 2009 ( due to preccupation)
What would you advice under the circumstances.

RTI Application Date: 10 Dec 2008
PIO reply: 17 Jan 2009 - 7 days delay
Time to file First Appeal: 17 Feb 2009 (ie 30 days from PIO's reply)
Therefore you First Appeal is time barred.
This is a trick played by the PIO.
In any case file a First Appeal and ask for "condoning of the delay of xx days" because you wanted to give m,aximum opportunity to the PIO to give you the information. Hope for the best.
Attend the First Appeal yourself.
