The applicant should be a party ,when CIC takes up penality proceedings anainst PIO.
It is seen in almost in maximum cases that the CIC does not impose penalty on PIO and satishfied with the reply submitted by the PIO no penalty is imposed on him . my view is that the CIC while disposing the penalty proceeding in which cases showcause notices have been issued the applicant should also be called as he is the effected party and he knows the case better .He knows that through how many difficulties situation he has passed ans how the PIO has harrassed him. Not offording an oppurtunity to the effecting party is also against natural justice .
