Unanswered: Filing RTI

Hello Sir

I need your help for one my case. Last month i filed a RTi to an Mumbai office. But after a months time also i havent received any reply from them. plaese suggest what should my next step

I dont know whether the procedure was right or not. I searched theaddress from the internet and according to the procudeure i made the complint in a white paper and posted to concerned dept along with the Pay order of Rs 10. How can we assure that they got my application and pay order.

Please suggest.

And how did you dispatch your application? Was it through speed post, registered or a private courier ? Did you track the delivery details of your letter ?

No, it was through ordinary post. How can I track such deliveries whether it has been reached to destination or not.
If we ask post office authorities they will say that "we have already delivered but we dont know what happens once it goes from us"
please guide me how to such handle such cases

Shibu you will need to go to the post office from where you have mailed the application and give a letter in writing to the post master alongwith the photocopy of payment receipt given to you if submitted directly to the post office and ask for the status of your letter, it generally takes a week's time to get post master's feed back.

Alternately you can file a first appeal believing PIO has not replied to your query, and the appellant authority will inform you that they have not received the RTI query at all.

Or alternately you can file a fresh RTI once again but this time through speed post with acknowledgment and keep the payment receipt as proof to follow up later with the post office incase you do not receive the acknowledgment

No point in asking the post master the delivery details of a letter sent through ordinary post. Records are not maintained for such posts and delivery of such letters cannot be tracked.

Since the application money for RTI has been sent in the form of a Pay Order, check up with your bankers regarding the fate of this pay order. If the Pay order has been presented for payment, then you can be certain that your application has been received by the authorities concerned.

In addition go ahead and file the first appeal to AA along with copy of RTI application and bank draft. Send the copy of that appeal to PIO too.

In case non receipt of application at PIO, he will immediately respond you saying that he has not received such application.

hi all

thx for all the inputs. But again lot of confusions r there. For ex: How can we track the Payorder; I have filed the RTI for Kandivali Office so shud i go to Kandivalli Post office and enquire abt that. Secondly in case of speed post also they will give the same reason that "we cant keep track of such deliveries. We have already forwarded to the mentioned address"

I think it would be better to file a fresh RTI aapplication but this time with DemandDraft/MoneyOrder and through Speed post. Can we get DD/MO for Rs 10. OR other than Pay order which will be the best solution.

Kindly guide me what all precautions shud be taken, what shud be the format while filing a RTI. Am planning for file once again.

Shibu,

The best way is to put a court fee stamp of Rs.10 instead of attaching a draft. You get court fee stamps from Borivali court which is situated right opposite Borivali (W) railway station from the court window by paying the exact value or you can get from agents sitting in the court lane a court fee stamp of Rs. 10 value for Rs.14.

In a similar registered AD case, I was asked by the postal department to submit an application at the post office for not having recd the acknowledgment, in the meanwhile I got the reply to my RTI itself so I did not go back to check the post master's reply, but I was promised that I will get a written reply within a weeks time as they maintain a ledger record of registered AD letters.

Shibu,

Your RTI application was addressed to RPFC in Mumbai. That is a Public Authority under the RTI Rules for the centre. Hopefully your application fee and mode of payment was as per Central RTI Rules (available here: http://www.rtiindia.org/guide/centre...-about-cic-19/ ) .

Since your application was sent by Ordinary Post, there is no proof that the RTI application was actually received by the CPIO in the RPFC office.

You can try both of the following two:

1. If your mode and fees were correct as per central RTI rules, file a First Appeal with the Higher Officer for First Appeal under the RTI Act in the office of the RPFC. They will at least search for your RTI Application and try to solve the issue.

2. File a fresh RTI application following the Central RTI Rules as indicated in the link given in this post.

thanks for the inputs, but have lots of confusion.

1. In your reply it is written "Your RTI application was addressed to RPFC in Mumbai. That is a Public Authority under the RTI Rules for the centre." — I didnt get the meaning of this.

2. Secondly even if I go for speed post/registry — how can we track whether they have received it or not. No acknowledgement is send back.

3. thirdly i dont know whom to address my application. the case is last year I underwent the exam for SSA in EPFO. and results are declaresd but i beleive some politics has been intervened in selsecting candidates. So shud i file my application to Central govt or state govt PIO. With great difficulty i searched one address of PF dept in Mumbai. And last time i filed my RTI to that address but it didnt worked.

1. As per the RTI Act, there are Public Authorities under the Centre and under State/Union Territory. RPFC is under the centre so you have to follow the RTI Rule and Fees for the centre.

2. For Registered AD, the AD card is returned to you along with the receivers name, signature, date and time. That is the record of receipt. For Speed Post, you can track your document delivery status online and take a printout of the final delivery status and keep it with you as proof of delivery.

3. Your RTI application has to be addressed to the PIO of EPFO. Depends on which part of EPFO conducted the exam for SSA. The list of all PIO's in EPFO is given here:
