    one problem in RTI application : non-mention of RTI act

    Dear All

    recently I have filed an RTI application to a govt department. in RTI application, I have addressed to Public Information Officer and attached on IPO of 20/

    but due to mistake I have forgot to mention application under Right to Information act-2005.
    no where in application it was mention that information was sought under RTI act-2005.

    now my query is: in such condition, whether PIO can reject my application? or he will have to consider it under RTI act?

    whether it is understood that addressed to PIO means sought information under RTI?

    please reply my query.

    why to be in doubt for full one month---please do send a fresh application and of course, now onwards you would never forget to mention at the top of that page --- Application for information under RTI Act 2005.
    Never mind, we all learn by such small mistakes.

    sir,
    not worried about that, if you address to PIO it automatically treat as RTI application. as per rules simple letter write there is no formal format required and PIO post creat only for RTI purpose and IPO only required in RTI application not ordinary application. so be happy. if PIO reject it then you have chance to file 2nd appeal to FAA

    The very post of PIO is created under the RTI Act 2005 to deal with RTI Applications (matters) only.

    When any application seeking information accompanied by IPO as application fee is addressed to the Public Information Officer, he has to deal with it under provisions of the Act.
