DoPT Circular regarding CIC/SIC not allowed to refund RTI Fees

DoPT has issued a circular No. 13/10/2007-IR dated 29/04/2008 informing that CIC/SIC are not allowed to order refund of RTI fees.

This is based on a order of the Ahmedabad Civil Court.

The circular is attached.

This circular seems to have been issued incorrectly.

If one reads the full order of the Court, it only says that the SIC has no powers to order refund of Fees - but the "fees" referred to are admission fees and not RTI Application fees !

Basically the court has held that SIC has no powers to resolve a civil dispute between two parties.

That may be a faux pas committed by DoPT. Hope they will issue an amendment to put the record straight.
