Need Help: What is the way for me, please tell me

Smt P. Balasubramanian of CIC tortured me by undue favors to PIO / AA. I applied for info on 22.10.07 . The PIO denied telling FLIMSY grounds; & to complete the formalities he supplied me some wrong info. Then my AA also dittoed with pio. When after 7 months long time , my hearing was done by CIC , she scolded me & appreciated the erring pio /aa openly. Thus after spending 9 months &Rs. 15000 , I could get nothing evn after CIC's internention. I demanded 300 informations relating to my chargsheet /dismissal from the bank service. But bank supplied me only 5 info & now 7 info after CIC order. I told them all that I need all the 300 info to get JUSTICE which is larger public interest.But P.Bala harassed me & did not listen at all. Now should I go to court? But I do not have money. Pl tell a cheaper & shorter , sure method of getting justice . Why the govt not taking disciplinary action against the erring CICs?

Dear Vijendra Singh,
I believe the decision in : cic.gov.in/CIC-Orders/PB-26062008-17.pdf pertains to your case. My reading indicates that this is about the 23 appeals and 5 complaints that you have filed against the bank and all these have been clubbed into a single hearing.

On carefully going through the decision, it is apparent that most of your RTI applications were in some narrative format, without specifying the required information in a pointed manner. This decision also notes that many of your applications were in the nature of questions and not by way of seeking information available on record. With the result the PIO has taken refuge that he need not answer questions.

Please remember that most of the PIOs in the banking industry have a legal background and they are always on the look out for deficiencies in your application to deny the info. We have no way of knowing the details of your RTI applications to find out where you have gone wrong, except for a reference to it in the decision.

If the RTI application itself is deficient and allows the PIO to escape without providing info, then it may not be proper to blame that the IC tortured you.

Forwarding number of applications on the same subject to number of PIOs and asking same questions in number of applications is nothing but misuse of RTI Act. About 30 appeals of yours were taken for hearing by CIC on the single day !

I find that 25 appeals of yours are still pending with CIC. Doesnt this cause unnecessary delay to thousands of appeals which are still pending at CIC ?

Dear Vijendra Singh,
Under the circumstances mentioned above, I suggest you to sit back and coolly decide as to whether your priority is to get the information or to win the case or to go after the pin-prick wounds caused by the PIO, AA and Information commissioner. If your decision is to get the information, go through your 300 questions, trim them to the minimum requirement, re-word them in legally acceptable format (they should not appear as the same you had sought earlier), make them into convenient batches as per priority in such a way to convenience the PIO. If needs be consult some learned RTI Activists or members of this forum. Start it all over again, now with small convenient batches of innoscent appearing applications. You may have to resort to building information bank step by step. You may not succeed if you try to get all the information in one lot as done now. Even in the present case, had the PIO been smart enough, he could have closed your case at the beginning itself with a stroke of reply that "it would disproportionately divert the resources of the public authority" . It need patience but the result you may achieve through RTI is cheaper and faster when compared to other conventional methods.

Sri Ganpat &Coln saheb, CIC told lies while deciding my case on 26.06.08. PIO did not refuse to supply the info flatly; he told lies eg. info not on record, half info is avalable, info is in your knowledge , info on disciplinary matter or administrative matter can not be given etc. etc. Hence this was CIC who should have warned the PIO not to act against HOLY RTI Act 05 & to supply the info urgently & also to penalise the erring PIO. but she did not perform her pios duties.My all querries were pin-pointed documents. I now want P. Bala & PIO be punished as per RTI Act rules. Pl see I sent Review representation to CIC on 8.7.08.Should CIC review its BAD decision ? Why CIC showed undue favors to erring PIO/ AAs ?Is it not MANDATORY to punish the PIOs who denied info on false/ flimsy grounds ; who supplied only 5 % of the demanded info ; who misguided me & the CIC both ;who insulted me writing rude-unwarranted replies ; who did not act willingly as per RTIAct05 .

No one is going to punish them at your instance in any case. How will you prove that the IC has scolded you ? I think it will be a futile effort. But you are your best judge. Good luck.
