RTI to prove Illegal Detention by Police Dear RTI Aactivist,
I drafted the attached RTI application to get data from a police station to prove illegal detention. I would like to share you the ground facts before explaining what i'm trying to do and i would be grateful to receive your comments in fine tuning my application.
On July 31st 2009, one of my colony residents(in Hyderabad) was arrested by police from Nalgonda district (These police are from another jurisdiction and the accused was from Hyderabad district) in a false 498a case(needless to say how abusive this section is). He was detained in police station and he was mentally & physically harassed for 4 days (till 3rd Aug 2009) in the same police station(bribery by girls family). Later, after extorting about 30k rupees(this was not bribe but a pray to police not to physically hassalt him. I agree he encouraged bribary but he had no option there to avoid physical assault)
On early hours of 4th Aug 2009, he was sent to judicial remand and the accused seeked the bail later.
However, when we read the case diary, police mentioned that the accused was arrested on late evening 3rd Aug 2009 and produced to Judicial office during midnight on the same day. This is the high point of false information as this guy was taken away from his residence in Hyderabad on 31st july 2009 itself.
Based on my understanding on how police works, i got to remember a point that they are bound to enter all their activities in a dairy called "General Diary (GD)" and also the fact that whenever police arrest an accused they are bound to intimate the same to the Polce Station where Accuses resides.
I tried to draft this RTI to get the General Diary(GD) from police station where accused resides to find if the police from Nalgonda district indeed noticed the arrest of accused to police station in Hyderabad. I'm sure they have not notified the local police and if they have notified, they would have notified on 31st July instead of 3rd Aug. Either way, RTI application should corner them.
Please share me related judgments in supporting to my application and i also request you all to help me fine tune the application. I hope i will get the info and prove the arrogance and unrude and corrupt way of police work style.
Can i give the RTI application to the PIO by hand(PS is very close to my residence) or should i send it through RPAD?
