Unanswered: Appeal against State Right to Information Commissioner.

Will some kind soul explain where does the appeal lies against State Right to Information Commissioner, who has greatly bungled, and let the bureaucrat go scott free illegally, and totally arbitrarily, against a large number of floutings of the RTI Act 2005 ? Central Inforation Commission states that the appeal against the SRTI Commissioner lies with the same SRTI Comissionner himself. Has not the RTI Act been hijacked by the beurocrats, as each one of all the Commissioners are Beurocrats, an act which has been necessitated only by the criminalities, corruptions, withholding informations, and secretive corruption parleys ?

This is the main impediment in the way of the Right to Information Act 2005. As on now, the Commission is not accountable to any one in practice. Kee...Zara...Zara....

If you start filing appeals in High Courts, it is bureaucracy - Indian style - the Act will be amended by brother bureaucrats where appeals against State Information Commissiners will lie with United Nations. I feel the Social Activists engagaged in RTI Act all over the country must sit together and make a hue and cry and force the Govt to amend this clause. In fact, I could not see this provision of Appeal against SRTICommissioner lying with the same Commissioner himself. Similarly, many state commissioners have devised a new way to discourage RTI movement by fixing cost of application and information copies 5 times the rates fixed by the Govt of India. What I feel is that the bureaucrats have devised these new novel tricks. Will some one refer to the section or clause in RTI Act 2005 !

Yes. One can go to High Courts and Supreme Court. An appeal on the grounds stated above will be futile. Of cource if one has extra money to waste nothing wrong in indulging in such luxury to get one's ego satisfied.

I have been suggestting for establishment of an "Information Commission of India" under whom all the SICs and CIC should be placed for effective control and coordination . I do not find any better solution to the problem.

Depending on which State you are referring to, just check if the SIC of that State allows a "review" of the IC's order/decision. If yes, you can file for a "review" by the Chief Information Commissioner of that State or for a larger bench to review your case. You will have to conclusively prove in your appeal for review that the order of the IC was incorrect. This could be a cheaper and faster alternative than going for a Writ in the HC.

The above is without going into the details of your case, since none have been provided.
