PIO/Income TAx served show cause to release compansation of 5000/-
Hi
I filed one RTI application to Income Tax Officer , he provided vague reply and I won the First appeal. But the PIO did not provided reply until I filed a complaint in his office and immediately he released the RTI reply , but that took 105 days after winning the first appeal.
I filed one appeal u/s 18 and 19 R/w 20 to CIC . CIC issued a show cause notice that why Rs. 5000/- compensation be not given to applicant for delay because of which I caused Rs. 2 Lacs loss.
NDOH is 30/07/2010

Did you ask for compensation in the prayer to CIC? Did you specify the loss you incur? Any justification about the amount of loss due to delay in reply?Sponsorer
The CIC is not very quick to award compensation, and not very keen on actually implementing it. Best luck.

Yes I asked for compansation in my 2nd appeal.
Since appeal took almost year to decide and till then I got one statement of my Father in law from court where he submitted to income tax officer that he has not given any maruti zen and AC in the marriage to me. The date of paper was before date of my bail order where I was compelled to pay Rs. 2 Lacs as I was not having any proof of my innocency.
So I raised the point before IC with copies of High Court Order and Copy of Compliance by paying Rs. 2 Lacs and copy of Statement of Father In Law so he agreed. I told him if the PIO could have provided this information to me then I could have saved my 2 Lacs of Rs. which I paid as I was not having any proof in hand but PIO /Income Tax was having the same and he did not released the same.
