    Second Appeal

    hi friends actually i have made a second appeal to Bihar State Information Commission for non reciept of reply from the concerned PIO, in this regards the Information Commission has sent me a letter informing me the date of hearing,

    in this pretext kindly tell me is it necessary to be present for the hearing as it is impossible for me to visit Patna as the date is of next week and also what if the appealant is not present for the hearing, does the info. commission decide in the PIO favor.

    It is not necessary for the appellant to be present during the second appeal hearing.
    If the appellant is not present, the SIC will decide the matter based on records available with it.
    If the matter is important for you, it is better that you be present and argue your case yourself. After all, you know your matter the best.
    In your absence, the PIO may claim something and the matter will be closed there and then by the SIC.

    sir can i send a representative if i am notable to attend the hearing also what is the procedure for it do i need to send an authority letter or is there any format for it, do i have to inform the commission in advance regarding sending the representative.

    You can ask someone to represent you during the second appeal hearing. It can be a lawyer or a non lawyer.

    He has to present himself for the hearing with a authorization letter duly signed by you.

    To Whomsoever it may concern

    "Reference case nr..............scheduled for second appeal hearing on.........at............ and your Notice of Hearing Nr. ....date................ for the said hearing, I hereby authorize Mr.......................to appear on my behalf to present the case and attend the hearing.
    The signature of Mr..............is appended below.

    Dear r199,
    It is always advisable to remain present during the Personal Hearing of Second Appeal. Firstly, you have reached that forum only becuase you did not get any relief in the matter of information/s sought which are important to you. Secondly, you can prepare further submissions in hard copy format and either read it out and then submit it with the final prayer that my written submissions be taken on record for the purpose of disposal of my Second Appeal Petition and my Apeal Petition and prayers be amended to that effect." Finally your presence itself will deter PIO/FAA from misleading the hearing and the bench both. Your presence will ensure an uncontaminated hearing of the petition and submissions.
