Dear Friends, I am from Mumbai and I would like to know some queries pertaining to RTI and other things applicable for Maharashtra Co-Operative Housing Soceities Act.1960 1) Under which section of RTI Act, we can ask the details of day to day activities of Societies, especially Statutory Documents such as Indemnity Bond from each members which is to be submitted to Registrar within 15 days of assuming the office? 2) Whether Income Earned (Shown around Rs.3,97,500.00 as Income over Expenditure in I & E Account) is going to attract Income Tax since the major portion of the Profit is Interest on FD in Banks and Overdue Interest Charged to Members on their Dues to Society) as the Committee has neither kept any provision for taxation nor paid any tax. So, I want to ask this question in ensuing AGM of our Society. So, please help/advice me on the matter at the earliest. Sadashiv.S.Acharya. Mumbai. |

Dear Sadashiv, If you are in Mumbai, then the office of Registrar of Co-operative Societies is located at 6th floor, Malhotra House, Opp. G.P.O, Mumbai 400 001. The office is divided in a number of wards, and the ward appicable to you will depend upon the area in which your society is located, for example my society is located in Borivali and so the ward applicable to me is R Ward. The Hierarchy in the office is as follows: 1) Deputy Registrar - XYZ Ward(Designated as PIO for the purpose of RTI Act) 2) Divisional Joint Registrar - Above Deputy Registrar's of all the wards (Designated as Appelant Authority for the purpose of RTI Act) You will need to find out which ward is applicable to your society, download an RTI application form, demand all the information you require under the title in the RTI form Description of the Information required, paste a Rs.10/- court fee stamp, address it to the PIO / Deputy Registrar Co-op Societies with the address mentioned above and mail it under Registered AD or Speed post with acknowlegment. |

Have u ever told ur secretary to make provision for Income tax, I think ur secretary might not having knowledge of making provision. I personally feel that RTI should be used only when the managing committee is not giving information or avoiding u. |
