    Default Pension account with State bank of India


    Hi,
    1. My father was a Sr. Doctor with Safdarjung Hospital, New Delhi and was employee of the Central Govt. Health Scheme (CGHS)
    2. He retired in 1990 and was receiving his pension at the State Bank of India, South Extension Branch.
    3. He had a stroke in 2004 and could not give his annual "Life Certificate" from 2005 till his death in 2008.
    4. Inspite of submitting all relevant documents with the bank , the bank has failed to update his passbook/ release his pension due/ clear his arrears etc.
    5. ALL queries with the said bank are met with..."We have send the documents to the central processing branch at Chandni Chowk".
    Now I wish to know under the purview of RTI who do I seek the relevant information regarding the status of my deceased fathers dues etc? The said Branch refuses to entertain any query.
    And secondly...what is the language that I need to use to succinctly put my case forward?
    Any reply regarding this would be most helpful, any links to similar problems too would be welcomed.

    If you have already sent written reminders to the bank, then the easiest will be to file a RTI application with the PIO of the Bank as per the format given here: http://www.rtiindia.org/forum/blogs/...ding-govt.html

    Make sure that the RTI is filed / signed by the person who is the legal heir of the deceased.

    The RTI has to be addressed to the CPIO, State Bank of India, xxxx branch, New Delhi. It can be submitted by hand to the Branch Manager. Preferably to the same Branch Manager where the issue is pending. All Branch Managers of SBI are Assistant PIOs and have to accept RTI applications and forward them to the correct PIO.

    Your RTI Application has to be as per the RTI Rules and Fees for the Centre.

    Pending Un-responded issues

    Please file RTI Application with the PIO of the concerned Public Authority (State Bank of India Branch) via Speed Post. While filing RTI Application detailing the problem being faced by you and quoted therein your all previous references of letter/telephone/personal visits to the office of the Public Authority and ask for the following information (Please use all or some points as suited to you. Point No. 6-9 below is essential for quick and positive action):

    01. Inform me the day to day action taken on my various requests made earlier (give date wise detail of your letters/visits/phone calls).
    02. Inform me the time needed as per law to finalize the required action.
    03. Inform me latest status of your request.
    04. A. Provide me the certified copies of the
    a. File Notings relating to this matter from DD/MM/YYYY to DD/MM/YYYY.
    b. Day-to-day moment of File relating to this matter from DD/MM/YYYY to DD/MM/YYYY. (Now, in a decision involving the EPFO, IC SG has clearly ruled that the day to day movement of the file has to be given in the format asked for. Please see http://www.rti.india.gov.in/cic_deci...14_M_37059.pdf
    05. Inform me reasons for the delay
    06. Inform me Name & Designation of the officers/Officials responsible for taking action on your request.
    07. Inform me Name & Designation of the officers/Officials responsible for causing delay on your request.
    08. This application may also be treated as a Notice u/s 80 CPC and the action taken thereunder may also be inform to me in due course.
    09. I have paid fee for the purpose. I am a consumer. The delay is a deficient service. Moreover I am being harassed. What compensation is proposed to paid to me. if Nothing, This may please be treated as a Notice under the Consumer Protection Act, 1986.
    10. Inform me the manner in which the PA is proposing to compensate you for the mental agony and deficient service.
    11. Any other point on your mind (Think Hard).

    The grievances arising out of unsatisfactory response or No response from the Ministry/Department concerned will be taken up by the PG officers of DAR&PG who will take up the matter with the Ministry/Department concerned for close monitoring and expeditious redress.     Most probably your work will be done with a quick pace, which you would had never expected under normal circumstances.

    Default To recover Salary from Railways


    Dear Sirs,
    I HAVE A SMALL PROBLEM WITH THE RAILWAYS AND WISH TO GET DETAILS OF MY FATHERS SALARY THROUGH rti CAUSE AFTER FOLLOWING WITH THEM FOR MORE THAN EIGHT YEARS I HAVE NOT STILL RECEIVED THE SAME AND AM STILL BEING ASKED TO WAIT FOR A MONTH OR SO WITH NO PROPER REPLY.
    MY FATHER WAS SUSPENDED FROM HIS SERVICES OF WESTERN RAILWAY, WHERE HE WAS SERVING AS TELECOMMUNICATION INSPECTOR (MUMBAI CENTRAL), IN THE YEAR 1984 AND WAS UNDER SUSPENSION DURING HIS RETIREMENT ALSO IN NOV 1990. AS THERE WAS A COURT CASE PENDING AGAINST HIM HIS SALARY SINCE SUSPENSION AND HIS RETIREMENT DUES WERE HELD UP BY THE RAILWAYS TILL THE CASE GOT OVER IN THE YEAR 1998 WHERE HE WAS ACQUITTED FOR ALL THE CHARGES FRAMED AGAINST HIM AND THE HONORARY COURTS ASKED THE RAILWAYS TO PAY ALL HIS DUES ALONG WITH HIS SALARY AND RETIREMENT BENEFITS.
    THE RAILWAYS PAID UP A PART OF HIS SALARY AND BENEFITS BY 2002 AFTER THOROUGH FOLLOW-UP BY ME AS MY FATHER HAS FALLEN ILL AND GOT A MINOR HEART ATTACK CAUSE OF CHASING THE RAILWAYS, I HAD TO TAKE UP THE MATTER TO DO THE REQUIRED FOLLOW-UP.
    MY FATHER EXPIRED IN THE YEAR 2005 OF A HEART ATTACK AND MY MOTHER IS RECEIVING THE PENSIONS TILL DATE BUT THE PART OF THE SALARY AND THE RETIREMENT BENEFITS WHICH WAS HELD BACK BY THE RAILWAYS IS YET TO BE RECEIVED BY MY MOTHER WHO IS ALSO A HEART PATIENT.
    SINCE MY FATHER IS NO MORE WE DON'T KNOW HOW MUCH OF THE DUES ARE STILL PENDING.
    HENCE I REQUEST YOUR KIND SELF TO GUIDE ME ON HOW TO USE RTI FOR GETTING THE DETAILS OF MY FATHERS PENDING DUES AND HOW MUCH HAVE THEY PAID SO FAR, ON WHAT BASIS AND WHETHER INTEREST SHOULD BE DEMANDED FROM THE RAILWAYS FOR DELAYING MY FATHERS PAYMENTS IN SPITE OF THE COURTS ORDERS TO PAY MY FATHER HIS FULL DUES.
    I WILL BE HIGHLY GRATEFUL TO YOU IF YOU CAN GUIDE ME ON DRAFTING THE RTI APPLICATION FOR THE ABOVE MATTER.

    Make a second RTI Application

    2. Please Supply me the copy of rules and regulations of the Railways with regards to PROVIDING THE SERVICE TO NEXT OF KITH & KIN OF THE DISEASED EMPLOYEE ON COMPASSIONATE GROUNDS who dies (a) while still in service of the Railways, as per rules of the Railways, (b) dies after the retirement.

    3. Please Supply me the copy of rules and regulations of the Railways with regards to PROVIDING THE FINANCIAL COMPENSATION IN LIEU OF SERVICE TO NEXT OF KITH & KIN OF THE DISEASED EMPLOYEE ON COMPASSIONATE GROUNDS who dies (a) while still in service of the Railways, as per rules of the Railways, (b) dies after the retirement.
    4. Please supply me the LIST OF THE EMPLOYEES WHO HAVE BEEN PROVIDED THE SERVICE since 2000 in the Railways, as next of kith & kin of the diseased employee on compassionate grounds who dies (a) while still in service of the Railways, as per rules of the Railways, (b) dies after the retirement. The grounds and rules under which such benefit was given, may please be quoted.

Please supply me the LIST OF THE EMPLOYEES WHO HAVE BEEN PROVIDED FINANCIAL COMPENSATION since 2000 in the Railways, in lieu of service to next of kith & kin of the diseased employee on compassionate grounds who dies (a) while still in service of the Railways, as per rules of the Railways, (b) dies after the retirement. The grounds and rules under which such benefit was given, may please be quoted.

The GROUNDS OF REJECTION AND UNDER WHAT RULES THE REQUEST WAS REJECTED, request for employment on compassionate grounds in case of _____________________ of son of Late Mr. _______________, diseased _________________, (Designation), who was sole bread earner of the family, may please be informed to me

    7. The CERTIFIED COPIES OF THE NOTING SHEET AS WELL AS CERTIFIED COPIES OF CORRESPONDENCE FOR THE ENTIRE CASE BETWEEN THE RAILWAYS WITH OTHERS , from 01 December 2007 till date may please be provided to me.

    8. The MONTH-WISE DETAILS OF TERMINAL BENEFIT PAID TO THE NEXT OF KITH & KIN OF THE DISEASED MR. ______________, (Designation), who dies (a) while still in service of the Railways, as per rules of the Railways, (b) dies after the retirement, may please be supplied to me.
