Question: Can we ask for the copy of the affidavit

This is my first query in RTIINDIA, please do answer this query.

Can we ask for the copy of the affidavit that was filed by the candidate during the election for "Town Munciple" and the asset details of the candidate in that Munciple office?

Welcome to RTI forum Raghavendra.

Since the information filed by the candidates is of public nature (Most of the election site put them on site too) you can ask for the information.

But I think Election Officer is the right place for asking the information. I dont know about your city, but in Delhi it is State Election Officer who conducts the elections.

Yes you can get copies of the affadavit. What you need to do is

1) GIVE SPECIFIC INFORMATION ON
a) Name of the candidate b)Year of Election c) Post (e.g. MLA/MLC/MP/etc.) d) the Consistuency.

2) REQUEST FOR
a). Copy of Nomination Papers b) Asset Decelaration made by the candidate c) Criminial Records on the candidate.

PAYMENT DETAILS
a) . Pay Rs 10/- by way of DD and suggest you request for perusal of documents before copies are processed since some candiate file like 50-100 pages which may not be of use to you need.

Dont' forgot to include sec 6(3) of RTI.

the information in question should be available with the respective district collector as the election are conducted under his supervision u can direct ur RTI query to the District Collector

What can be done if in case the candidate has filed false information related to -
1) Assete details
2) Education qualification
3) Criminal back ground

If you can prove that he has filed false details in the affidavit, you can complain to the Election Commission.

Filing a false affidavit is a criminal offence. The guilty has to face all the consquences if the guilt is proved

Finally !!! I got the certified copies of the Asset details, Educational Detail etc of the town munciple councilor for which I had filed an RTI application.

In the nomination paper she has (the councilor) mentioned only 1 property (agricultural land) and has not mentioned the other 2 agricultural property her husband ownes.

What action can I take against this?
To whom should I direct to ?

Please guide me.
