Re: Can we ask for the land details

Yes, you can certainly ask that. You should file your RTI application to concerned Land Revenue/Tashildar office. Since the procedure differs from state to state I suggest you to visit the site of your state govt.

Re: Can we ask for the land details

Every square inch of land is accounted for at various individual municipal levels. It should not be a problem seeking information on the subject you have mentioned.

Even after 1 month filing the RTI application with the Tahsildar to get the information regarding the details of the land holdings of the councilor’s husband, there is not even an reply from the Tahsildar towards the RTI application I had sent throught the registered post.

What is the next step I should do in order to get the information?

Re: Can we ask for the land details

Raghvendra ji

If no reply/ not satisfied with reply in 30 (or 35 days in case of submission to APIO or under Section 6(3)),
First Appeal to the First Appellate Authority (normally a officer higher than the PIO)

File first appeal ( for calculation please add 5 days for postal delay)

For help please see:

1. Karnatka RTI rules:
KARNATAKA RTI RULES - RTI Guide
AND
Karnatka RTI Amendment: Amendment to RTI Rules in Karnataka

2. How to write First appeal:
How to write First Appeal under RTI? - RTI Guide

3. Well drafted sample first appeal by Karira Sir:
Disregarding RTI Act

Possibly this info will be of good help to you
Revert back if you still have any doubts, members will definately help you out .

You need to file first appeal for denial of information.

Re: Details about the loan the counciller has in an Nationalized bank.

The first appeal is to be filed to Appellate Authority who is an officer senior in rank to the PIO. You can find the details of the AA in the same manner as you found about PIO.

For the format you may use the format attached to this post:
Disregarding RTI Act

Feel free to revert in case of further queries.

Ragahvendra,

Please refrain from posting the same post in two different threads. You will thus get replies in two different threads and get confused.

Third party information can not be taken under RTi. If the information relates to other person. If the PIO is conversent with the RTI Act he may refuse to supply the same.

The land records are being asked of a Councillors husband. It should be in larger Public Interest.

Please see similar information sought by the same applicant:

But Karira Sir When we ask for the property and property return details of an officer it is denied saying it is a third party detail. Though it is also in public interest.

Rajesh,

In this case, the Councillor is a elected representative of the people.
Please see the detailed arguments given in the other thread by the same poster:

Asset details do not match!

Hello All,

The details regarding the asset of our areas Town Municiple Counciler DOES NOT MATCH with the one she has mentioned in her "nomination paper".
I got the details of the land holding of her and her husband from our Taluk Tashildar by filing an RTI application.

What's the next step I should take? Should I complain to the Election Commision or to the District Election commision for furthure action.

Please do guide me in this regard. Thanks in advance.

Best regards
Raghavendra

RTI is meant only for obtaining information. Your matter is complete as far as RTI is concerned. Now what you do with that information is upto you.

You should approach Election Commission, but now the issue goes out of purview of this forum.
