Sir I want to Know how to get the details of NSC certificate If we have only the serial no of NSC which is mentioned in the Will and the case is pending in mumbai court, we dont have the NSC CERTIFICATE and no idea in which post office the NSC is purchased can I go through the RTI to the main Head POST OFFICE IN MUMBAI is they help us.

Welcome to forum Anand.

I suggest that you should first ask from Head Office (using RTI) about the details of post office who issued that particular NSC without mentioning about the court case.

Thereafter you can contact the concerned post office to know about the details of receiver. In case they dont, use the RTI tool again.

Before you read any further, I request you to have a look at the following two judgments of the CIC.

From the first judgment it is clear that one needs to furnish the following details for the CPIO to locate the required information regarding NSC
1. The certificate number
2. The date of purchase

However the CPIO can not refuse the information in absence of these. Moreover you already have the certificate number with you. Thus i dont see much problem in this regard.

But a look at the second judgment reveals that only the original buyer of the NSC can seek information into the same. Thus it is more than likely that you shall be denied information on this basis. Eventually the CPIO would ask you to furnish a certificate of "legal heirs", but I assume you do not have this as your case is still pending in the court.

The only way out I see is keeping the CPIO in dark about matters. File an F.I.R at local police station that the NSC certificate numbers so and so were lost in some accident or theft along with some other valuable documents. Then file an RTI application telling them about how you lost the certificates and wish for duplicates to be provided. Also check if the NSC has not been encashed already. Ask them to cancel the previous certificates. Along with this attach a copy of the will and FIR. If the will entitles more than one person to have a claim on the NSC, then the application would have to be a joint application. Do not mention the pending court case.

Better still, consult your lawyer in this regard. He would have better options or opinion than what we amateurs have been able to cook up. as the above method is more than likely to be wrong. The postal department would have certain protocols or guidelines regarding issuing of duplicate certificates etc.

Sir In my Court Case that our uncle had submitted a Will to the Court and the mumbai high court is dismissed the case and we had oppinted a commissioner for local investigation on that Will of some shares and Nsc and many more property documents which is mentioned in the will .We got lot of information while investigation but sir in Will they are mentioned only NSC CERTIFICATE NO they had not mentioned which post office they had purchased for that purpose can I go through RTI to get the details of that NSC Or can I write a letter to the MAIN POST HEAD OFFICE MUMBAI with the NSC CERTIFICATE NO. Plz help me .

Im not very sure about what an NSC exactly is and how it is issued etc. If the certificate numbers are unique all over India or at least a state even, then the information should be available from the Main Post Office. It would also matter as to when these were bought. If the records of purchase are centralized in some govt dept then there shouldn't be a problem. The CPIO would also decline information if the NSC were purchased more than 20 years back. Only a deeper understanding of the protocol for issuing NSC could reveal as to how an RTI application may be filed.
The best thing to do under present circumstances is to file your RTI with head post office of mumbai. Only cite the certificate numbers. I think it should be sufficient.

By the way what is that NSC valued at? Calculate your steps before you take any. Dont end up spending more than what they are worth.
