While nothing is mentionrd about the proof of fee in the RTI Acts, I recently read the CIC Regulations 2007 and its section 11(ii) read as follows: The Registrar shall also ensure that the appeal or the complaint petition contains copies of all required documents such as (i) RTI application (ii) Receipt of the RTI Application (iii) Proof in regard to payment of fee/cost, if any; (iv) Decision/reply etc. from the CPIO, if any; (v) Appeal to the 1st Appellate Authority; (vi) Decision of the 1st Appellate Authority, if any. Since I dont have copies of my IPOs which were attached to my RTI applications, what are the options in case I have to file a second appeal ? In all my RTI application I have mentioned about the number of IPO as an enclosure.

Rule states RTI Applications without any application fee or BPL Card certificate, should be ignored. The registrar is only making sure that your RTI Application was not rejected on this ground and hence the necessity for attaching the proof for payment of application fee. |

This post remind me a joke. Once an audit party of a particular treasury had observed that the treasury has not obtained the 'life certificate of a pensioner for a particular year. When the Treasury pointed out that since they are in posession of the life certificate of that pensioner pertaining to the current year they did not insist on his life certificate of previous year. But the audit did not accept and insisted production of the life certificate of previous year telling that the certificate show that the pensioner is alive during the current year but the treasury has no proof that he was alive during previous year. The entire payment made to him during previous year was kept under objection. The CIC's (Management) Regulation contain far too many howlers of similar style.. I had posted them in various forums after communicating them to the CIC and his Legal Advisor Prof.Nigam who had promissed to scrutinese them but nothing heard since last one year.. Any way, after the PIO has accepted an RTI application with no observations on payment of fee, the issue is redundant. This is more so when he and his FAA have furnished replies without any observation on payment of fee. The relevancy of such proof come in only when payment of fee is an issue. The necessity to indicate the proof of payment to the PIO is, perhaps, only in the cases where the PIO has denied info only because the necessary payment was not made. Hence in other cases, one can mention that necessary payment has been made and that it was not disputed by the PIO or FAA and the applicant does not have the details just now. That should suffice the Registry to satisfy themselves on this count. Rules are made keeping so many contingencies in mind. They are expected to be applied keeping this in view. |
