In a recent decision, CIC has ruled that BCSBI is not a PA as defined in the RTI Act. The applicant had wanted information on Catholic Syrian Bank Ltd. and since it was a member of BCSBI, the applicant applied for information through BCSBI. Main reason given by IC PB was that although RBI did fund BCSBI for the first 5 years, in the last 2 years the funding was less than 50% and RBI had no managerial control over BCSBI. Decision does not appear to be correct. The I.C. herself observed in this case that the 'board' is being funded by RBI SUBSTANTIALLY . Moreover the 'board' perform duties as directed by RBI. It clearly proves that many info of board performance is maintained by RBI. In view of all above , the 'board' can not be said to be private body .
