where must be the fault.....???who else is responsible...??? Hi Team,
I am Swapna,
This was a certain problem which we have been facing for 15 years regarding a Pending court case.Coming into details my father was a central gov employee,he had been accussed in a scam under the working department when i was a kid.
After a long procecution of almost 5 yrs he was found innocent. Then as per the court order he had to be taken into services as he was under suspension, instead he was dismissed from the service.
Regarding this he filed a case against the action taken by the department in High Court of AP,but the case was still lagging behind and no result till now....looking hoping for the hopeless.
Now,my query was
As the case was closed and my father found innocent, why the certain department delayed in posting....whom can we ask for that...though we filed a case against the department it yeild no fruits.
Such delays in taking action lead into troubles, around 15 yrs we are facing economical problems as the head of the family was ruined.
How can a common man solve these type of problems, neither he have money to spend nor power to proceed.

This is our legal system. Cases about playing cricket and things like that get overriding priority in disposal over cases like yours, leaving families in distress. As far as your case is concerned, if the court has told to reinstate your father, there is no way the department evading it and 'dismissing' him. The order must be something different giving scope to the department to take the action it has taken. Please go thru the order again. Assuming that the department violated the order of the court, the correct course of action would have been to go for a contempt of court petition. That would have been decided faster and the department also would have responded swiftly. Now, you have to see a good lawyer and get his opinion whether such contempt petition can be filed now. Your lawyer also has to make sincere efforts to get the case heard quickly.Sponsorer
