Need help to format an RTI against co-op hsg soc managing committee member

This is Ishwar, Warm regards to all, I need help to format an RTI application to be submitted to secretary of my co-op hsg soc. I will really appreciate if someone can help me with it.

Hey Ishwar.....can v give an application under RTI to the managing committee of the co-operative society????If yes, is it necessary to address it to the secretary of the society as required by the bye-laws of co-operative societies act, or can it be addressed to the chairman as well????

You would have to address the application to the
CPIO
o/o Estate Officer

of your city.

Since co-op societies are not directly covered under RTI, keep in mind the following while asking for information:-
1. The information requested would fall in the category of third-party information. If the information is denied then you would have to prove the greater public interest in divulging the information to you.
2. Only documents or information accessible to the estate officer or any other govt officer under any prevalent law of land shall be covered under RTI. Thus do not try to seek answers to questions you might want to ask the president of the society as he is not under any binding to answer them.

Thanks jiwateshwar for the reply....my concern is that doesn't co-operative housing society get covered directly under rti as it is established under a state/central govt. legislation??? Pls help....I would like to learn more on this act.

The matter would depend on the act the co-op society is registered under. Which act has the society concerned been registered under? Which state?

Dear Ishwar,

I understand you are in Mumbai, then the office of Registrar of Co-operative Societies is located at 6th floor, Malhotra House, Opp. G.P.O, Mumbai 400 001.

The office is divided in a number of wards, and the ward applicable to you will depend upon the area in which your society is located, for example my society is located in Borivali and so the ward applicable to me is R Ward.

The Hierarchy in the office is as follows:

1) Deputy Registrar - XYZ Ward(Designated as PIO for the purpose of RTI Act)
2) Divisional Joint Registrar - Above Deputy Registrar's of all the wards (Designated as Appelant Authority for the purpose of RTI Act)

You will need to find out which ward is applicable to your society, download an RTI application form, demand all the information you require under the title in the RTI form Description of the Information required, paste a Rs.10/- court fee stamp, address it to the PIO / Deputy Registrar (XYZ) (replace XYZ by finding our which ward is applicable to you) Co-op Societies with the address mentioned above and mail it under Registered AD or Speed post with acknowlegment.
