Suggestion for first appeal

One Secretary to the Govt. of West Bengal , requested the Registrar, for disposal of any dispute regarding illegal construction and selling of flats of the said society amicably across the table after discussing the issue with the present management of the society. He also mentioned that “This may kindly be treated as extremely urgent. A report in this regard may be sent to this department immediately after holding the meeting..”
In this connection one member submitted RTI application to the Registrar.s office as below:-
1.Did the RCS arrange a meeting with the ‘present management of the society’ ?
2. Did the RCS send the report as asked for urgently to the Coop. Deptt after holding meeting ? If not , what is the reason thereof ?
3. Please provide the applicant a copy of the report submitted , if any.
Reply received query-wise mentioned below-
!.Nothing on record in this regard .
2. Does not arise.
3.Does not arise.
The applicant simply could not believe how a Govt officer could furnish such a rubbish reply ( only to hide corruption.)
It is very difficult to believe how a subordinate officer could ignore such urgent direction , which was supposed to be carried out 'immediately.' The extremely urgent matter could also be avoided and ignored ?

But after 14 months period of receiving that direction of his senior officer he simply ignored it.
Experienced RTI activists are requested to suggest framing of first appeal on it , so that the matter is dealt properly.

This would need only a simple first appeal. Just blame the CPIO for negligence and passing a decision on the application without actually looking into the matter. Request the FAA for providing the required information by directing the CPIo to give it to you. Seek departmental action against the CPIO. In the meanwhile file another application to the secretary's office which had issued the order. Ask the CPIO of his office to provide you with copy of the correspondence between the secretary and the registrar in regards to the matter concerned. If you have a copy of the letter already, then just include its photostat and ask them to verify if the same is true copy and when was it posted and proof of postage and receiving.

You can also ask the Secretary for specific details/copy of the report if any submitted by the RCS on the basis of the earlier directive by the Secretary.

Copy of the letter of the Jt. Secretary as well as that of the Minister have already been received through RTI application. But the SPIO mentioned that -- Nothing on the record etc. While asked the SPIO of the Secretary's office in previous occasion they replied - there is no specific time schedule for reply etc. The point is both Jt. Secretary and even the Minister himself directed to discuss the matter (urgenlly) but the Dy.RCS simply informed - Noyhing on the record---. I did not simplt understand what should be framed. As there is a biased SIC, whose work is to pennalise other SPIOs , but not any SPIO of the WRITERS' Buildings, main adm office of the WB state Govt.
