Consumer Forum vs Supreme court of India

can a product be sold at higher rate tahn the MRP inscribedon the label of the product? Jago India Jago campaigns which is spending crores to spread awareness advocates that none could be charged higher than the printed MRP on the product.
The apex court however has ruled more than once that MRP can be breached by the elite club of 5 star restaurants , airlines etc etc.
Should the govt still spends crores on JAGO INDIA JAGO campaigns.

Re: Consumer Forum vs Supreme court of India

Hello,

In Bangalore City Railway station, i have to pay Rs.15 for a Liter of water. But the MRP is Rs.10. Since i was in the train from Mysore to another place i had no option but buy for this price. These guys does not give bill and if you argue, they may push you from the train. I think the Bangalore group can take up this issue. I wonder why Indian Railway could sign up with a water company and put MRP and Railway brand in brighter to sell this for a reasonable price by exclusive water cart in the platform ?. Tnx.

Normally they ask more than MRP(MRP is Rs.10) if you have time you can lodge complaint in this regard to Station Master/Station Superintendent/Dy. Station Superintendent. Visit their office ask for complaint book and note the complain with your details. You can take RTI route also.

Re: Consumer Forum vs Supreme court of India

dear friends
my point is different. Hon. Supreme court in it's ruling on the issue has ruled in favour of the Hotelliers/Air ways for selling goods in open defiance to the competive commission at higher rates than the inscribed MRPs. It is on records . Someone dealing with legal records amongst the RTI activists may help us digging the exact AIR.
My point is we either respect MRP or let the market decides.

MRP: Maximum Retail Price

means that the product can be sold at that maximum price only.
Previously (till about 2 to 3 years ago) the dealers/vendors will escape with the excuse that MRP syas in small letters below "local taxes extra" - and he is charging you more on account of that.
I think form October 2007, MRP is now supposed to say "inclusive of all taxes" so there is no chance of charging extra.

In AP, the Weights and Measures department has been trying to book dealers/vendors (especially theatre owners) for charging more than MRP, but without any result. They go back to the old ways.
Manufacturers are also helping them by providing packs which do not state any MRP !

If it has happened at a Railway Station, you can definitely complain to the Station Master - but you will need a bill to prove your case.

Re: Consumer Forum vs Supreme court of India

Dear Friends
i still insist that my point is diffrent. There are two aspect to it - one The whole concept of printing MRP most adhoc in principle. I have in this forum has highlighted where a branded product has been printed with MRP far in excess giving leeway to the dealers , retailers. We just can not trust this MRP to be genuine /well supported by the cost of manufacture etc etc.
Second aspect is - If the MRP is printed whether a retailer can charge in excess to the printed MRP ?
My answer is YES as our APEX court has the power to the elite class of retailers in the forms of 5 star hotels etc etc to actually violate the order on MRP and sale the product at a higher rate above MRP. Now the point is why we are not fighting a case against the verdict of the Apex court which makes a mockery on the issue of MRP ?
