Need Help: Receovery of pf funds

I have worked for an organisation for 4 years from feb,03 to feb,07 in Ahmedabad.

Its headoffice is in Mumbai.

I have submitted form 19 and form 10 c duly filled directly to Mumbai office on 17th July,07.

After regularly following up with HR Dept. , in July,08 that is after 1 year of submission of my PF papers the HR dept told me that your PF papers are not been able to reloacate in the PF office.

I checked on Website of www.epfindia.nic.in but the claim status showing was you claim not received by this office.

That means the HR dept have hold my PF papers and not submitted the same in PF Office.

Again i filled up form 19, form 10-c and SSN Form and send to my Mumbai office on 7th August,08.

After following up with my HR they didnt responded. Hence i copied the mail to the Group Managing Director.

His message to me was " stop mailing me , i am not the person who is doing HR Work"

Than i send the message to him that i just copied to bring to your notice that how the HR work is going on. Till 1 year my PF papers are not submitted by the HR Dept.

Then again he replied on the to his HR dept that " donot do anything in this issue "

This means he instructed his HR people to stop the process of submitting my PF papers to PF office Mumbai.

After one year of mental harressment i have decided to take some Action against them.

Can you please advice what action can be taken for the same and how to proceed for the same.

is the organization you mentioned a public authority.
if Even after submitting papers to PF authorities if the PF authority does not take action to settle your dues, you can use RTI on PF authority to get the info on status of your case.

The Company for which i worked for 4 years was Private.

They have yet not submitted my PF papers since 1 year.

They are telling that your pf papers are not relocated in PF office.Hence you have to fill another form and send us.

I have already submitted another forms to them.But still they have not submitted the same to PF office only because i mail to the Group Managing Director for the same.

What action can i take for this.

you can use RTI with respective EPF office on the details of remittances by the company and its details for the period you had worked with company. this will help you in knowing your contributions have been deposited with EPF. then with copy of "acceptance of resignation" you can approach EPF tribunal for getting it refunded. Or you can make a complaint with registrar of companies/ Ministry of corporate Affairs and track it with RTI

fill pf form & get it approved, signatured or attested by bank manger where u have an acct & deposit PF form & u will get money in 2 months, no need to go to ur employer

get ur pf 10c & 19 form attested by bank manager

You can make a complaint to the concerned EPFO (where your account is maintained) that the employer is not cooperating. It is the duty of the employer to forward your claim duly attested. If he fails in this duty the Regional Provident Fund Commissioner can take action against him. Ofcourse there are other authorities who can attest your claim form.
