The primary objective in RTI is compliance - that is furnishing of information to person seeking it - in crime also the purpose of punishment is to deter crime - and prior to punishment it is established (i) who is guilty ? and under what motive ? It is also true that for serious crimes severe punishment deters offenders in future. Therfore, punishment for default (also reward for compliance) needs to be seen as a tool for compliance of rules. A PIO/APIO needs to obtain an information from one of the babus and furnish it to information seekers - and information may not be readily available/located in the department due poor record keeping also. Thus default may not on the part of PIO/APIO but actually babu (scape goat) is to be punished - the act does not help identify defaulting babu or PIO/APIO has little power to punish babu - actually in govt. hardly any one has any power to punish a govt servant - it is a matter that everyone sidetracks. Why not lets us device a method of rewarding an Appellete Authority ? |

.. yes but PIO is above "babu", and being a gazetted officer, he has all the powers to reprimand the "babu" and pull him up to whom the job is allocated. So is AA. Why should you REWARD him for doing his job. you should definitely seek "Award of punishment" if he does'nt. |
