    Angry No Action, Just Phone Calls. How to proceed ? What to reply ?

    Hi,
    I had applied for 'First Appeal' because of no response(Deemed Denial) of my RTI enquiring the status of my IT-Refund(AY 2007-2008) application.
    Now, some officer responsible had called my home and conveyed that I need to get my Form-16 immediately(today) and visit the IT Office.

    My queries are:
    1. Why should IT depart ask for Form-16 now ? I mean, they already have it when I filed my returns.
    Also to note: Its the first appeal of my RTI application and has no relation to Form-16.

    2. Can they call me at such short notice ?

    3. Can I ask them to send their reply by post and insist on giving me advance notice with list of documents they need from me ?

    4. I suppose I can still insist on reply for my RTI, even after they refund AY 2007-2008 amount ? Would it be ok to do this ?

    Then calling you for Form 16 and your first appeal are totally unrelated.

    You filed first appeal because the PIO did not give you information. Pursue that independently.

    Visit the IT office with a copy of your Form 16 and clearly inform them that you had submitted with your IT return. Do not mention the RTI application oir your first appeal.

    The two are independent.

    Present IT return need not be accompanied by any documents, not even Form 16. See the income tax site for more details.

    Dear All,

    Thanks for all your inputs for all the queries raised by me.
    After filing the first appeal for 'Deemed Denial', I got all the refund that was due.

    Initailly they tried to confuse and complicate by calling up and saying about some other Assessment Year other than the one I had applied for. Also forwarding the RTI to some other incorrect Ward, even though the ward i mentioned was correct.
    Later, when I stuck to my stand of getting whatever information in writing... all things fell in place.

    An electronic transfer was done to my account with interest and I got my refund.
    I am really glad with the help received from all the members from this group.
    Please move this thread to success stories.

    Through RTI I got what i needed... Infact i haven't visited the IT department even once.
    Just RTI-ing and Registered Post-ing.
