    Post DPC panel formation rules central govt

    DPC held in Oct2005. No further DPC in FY05-06. No panel formed. Two officers in higher rank retired in Jan2006.ACRs are written F year vise.
    Whether panel against two retiring officers was to be formed as per the rules.
    Whether any rule is there where the ofiicers are retiring in jan2006 but candidates in lower scale can be promoted in advance in DPC held in oct2005 . central govt departmentplease clearify

    File RTI app with respective dept and know rules of DPC formation
    then ask for when was DPC formed and till what date it had the power to exercise
    ask for POSTS or Designation which were promoted and which were NOT promoted
    and other such details

    If the ACRs are written financial year-wise, for filling up vacancies arising in a financial year (FY), DPC should be held in the previous FY. For this purpose the likely vacancies that may arise should be calculated correctly. For example if 5 vacancies are likely to arise in the year 2005-06, DPC should be held before January 2006 for these vacancies, so that the vacancies can be filled up as and when they arise after 1/4/2006.
    Now the next query- can any one be promoted to a higher post when there is no vacancy in the higher post? Normally this cannot be done. But there are exceptions provided under the General Financial Rules. Suppose there is a heirarchy of posts A - B - C. A, higher than B;- B higher than C. For anyone to be promoted from C to B there should be a vacancy in B. But, if there is no vacancy in B but there is a vacancy in A, then from C one can be promoted to B, against the vacancy in the higher post of A. This can be done with the sanction of the Ministry or Department, as provided in GFR.
