| I have 498a against me in Hyderabad/Andrapradesh (though me and wife are living in US; she filed it there, once she realized our marriage is not going to work and she cant win over me in the US courts). I spent few hours in trying to understand this RTI. Can anyone clarify the following pl --my father in law in FIR says he spent 50 lakhs on wedding. what is the website where I should file RTI online to get his tax filings. How can I pay fee if applied over the internet (credit card??). --I am very sure, he never filed the taxes. How and where should I file the complaint that he evaded income taxes on 50 lakhs. Will this be effective? Will I be able to complain over internet. Rgds Kris |

Though the RTI application can be filed through Indian Embassies, I suggest someone from India should file the RTI application on your behalf. Income will refuse if you ask for the Income tax return of third party as this will need permission from third party under Sec 11 of RTI Act which you will never get. However you may ask for the details like gross income, taxable income and tax paid extra by your father-in-law. In case he has not filed the tax, you can file Tax evasion Petition against your in-laws.

RTI India Welcomes you Mr.Kris. You can file RTI on line but there is no provision to pay the fees yet, you have to pay fee by Bank Draft,IPO etc, addressing to the Accounts officer of concerned Dept. payable at ... . Hence you have to depend upon postal line. Please browse through the different threads related to Income Tax available in this portal. Yours sincerely, a.k.mishra

Reply from India consulate in london about RTI 3. Let's see if this gets Indian Embassy in Washington to accept RTI Applications 4. Can a PIO or a OIC apply under RTIA 2005 ? 5. dear sir write me full about your case i m advocate and i try to advice you the best on 498 a. secound thing is that the meaning of 498a is you beet her or made crulity. i advise you to file application u/s 482 cr. pc to the high cort consern |

I got US citizenship a month ago. Am I still eligible to file RTI. If not, which is the quickest procedure (like PIO etc). I still have Indian passports with me, is that sufficient for filing RTI. |

Desiap, You may look at Save Indian Family Foundation for specialized advice on 498A and how RTI can be used. Try calling one of the USA helpline numbers. Instead of exloring the RTI on the Income Tax front, you could try filing Section 3 of D.P.A.... Orelse you could try Sahanaindia.org... Cheers, Manoj |

Manoj I am recent member of those groups. I went for FIR quash in HC after about 1.5 year of 498a filing. I will find about the sections you suggested. Thank you |

You can post RTI Complaint & APppeals at RTI Complaint & Appeal. but as it was mentioned earlier that you need to pay postal fees , again manual work nothing automated in that ![]() |

At above site, I cant find hyderabad in drop down. I select union minstry --> ministry of finance, department --> department of revenue; then I dont see Hyderabad under organization/public authority (though I see chief commissioner of income tax for few other states). Is there a separate site for andhrapradesh or should I pick something else under union minstry. thank you |

In your case you can summon the file of your Father -in-law from income tax department through court. Ask your advocate to request the Judge to summon the record. At the same time you can send acomplaint to the income tax authorities along with copy of 498 a complaint in which your F in L has claimed that he has spent Rs 50 laks on marriage .I think this will click and your F. In .L will be in trouble If he is worng. By filing RTI application you are not going to get any information because all these are third part information. |

| I got an incomplete response from IT dept. Now I want to file an appeal to commissioner-income tax-andhra pradesh. Can some one tell me how much fee I have to pay for first appeal in state of andhra pradesh. thx |
