Bank of India ordered to supply ATM failed transaction details and allow Inspection u/S 4
In the 2 Complaints lodged with CIC the hearing was conducted on 04/11/2010. The Results are as under:
1. Failed ATM issue: CIC has ordered full list of failed transactions within 15 days. Now this starts the checking of failed transactions with Bank of India and clears obstacles for payment to persons who have not received or compensated by Bank.
2. In Inspection under Section 4 to check the record of failed transactions and procedure set etc u/S 4 the Inspection is allowed. This will ease the matter with other Banks also as I can straight put a requisition or request for inspection of failed ATM Transactions.
3. CIC ordered Bank to implement Section 4 and reconstruct the web-page in 3 months.

Good effort. The order is encouraging. The direction to upload copies of orders/circulars etc about the various items under Sec 4 gives a new dimension to the contents of disclosure.Sponsorer

Congratulations! Mr Phadke you have done a great job Till today we are of the opinion that under Section 4 of theRTI act is mandated sou motu disclosure of information in public domain by public authorities. As we concentrate on Section 4(1)(c) of the RTI Act:
"4.(1) Every public authority shall----
c) publish all relevant facts while formulating important policies or announcing the decisions which affect public,"
Till date we stress on the plain reading of Section 4(1)(c) of the RTI act in which it is dircted that every public authority is required to publish or disclose all facts and circumstnces which are relevant and taken in to account while formulating policies and taking decisons that would affect the public.
Mr. Phadke, Section 4 if used at the high scale it will lessen the burden with RTI Applications, as most of the RTI are based with seeking answers to baisc questions and more than 90% questions are based on the fuctioning of a department. If the functioning is uploaded and the information is provided under Sec 4 then the unnecessary paper work and litigation will come to end.
So, I request the hon'ble members to please guide the other members regarding Sec 4 of RTI Act. As most of the members are having no knowledge about Section 4, inspection under Section 4.
As it is a very useful chapter of RTI Act. Secondly we don't get much material in this topic on website.
