What are the remedies available when the second appeal under RTI Act i.e. before CIC is dismissed and one is not satisfied with the order? Whether review and revision is allowed against the order of CIC ? whether appeal is allowed in High Court and order passed in second appeal by CIC and if so which HC it should be filed? |

There are two choices: 1. Ask for a "review" of the order/decision under Sec 23 of the CIC (Management) Regulation 2007, available here: The Central Information Commission (Management) Regulations, 2007 You should have strong grounds to ask for review. 2. File a writ in the High Court. I think it should be Delhi High Court - but not too sure if it can be filed in any other HC - just wait for some legal member of the forum to reply. During the conference dated 15-7-2008 the CIC has amended the review procedure. Accordinglythe CIC has laid down that review will lie only in cases of 'Errorof law apparent on the face of records or an error of facts .ie., The CIC will accept review of his own orders only if it fall under Order XLVII Rule 1 CPC. I think he has issued or under issue of amendment on the CIC's (Management) Regulation 2007 |

Thanks a lot for this valueable information. Yes I think my case fit into it. Is there any procedure to seek revision by Chief Information Commissioner. Are the rules of the CIC available on net? |
