Vishal,

If the PIo does not reply to you within 30 days of receipt of application -
Then file First Appeal.
If no reply to First Appeal within 45 days (30 days normal + 15 days extra with reasons for delay in writing), then go for Second Appeal cum Complaint for "deemed denial of Information". Second Appeal - because you already filed First Appeal with no result and Complaint because of refusal of information under Sec 18(c).

Just follow the RTI Rules for Second Appeal and SIC/CIC rules/procedures for Second Appeals, if any.

There is no time limit for state information commission to dispose of your appeal. Waiting period differs from state to state. U need to wait.

if you have already received the information through your first appeal then you need not file a second appeal. in case the information was received from first appellate authority after filing the second appeal, then you need not do anything. don't worry. just sleep over it and let the faa or cpio take care of the rest. they would themselves notify the sic!

thanks for ur reply. i have got the decision in my favor that i must be provided the information i demanded for, in the bounded time in my first appel made at seceteriote. but even if 45 days have been passed and i didnt get the information needed very urgent . as i have made an second appel in state information council. plzzzzzzzz tell me when will i get the information.

Are you saying that the First Appellate Authority directed the PIO to disclose the information but the PIO is not following the order ?

If yes, you have the choice to file Second Appeal with the SIC/CIC but it is a long and cumbersome procedure.

The easier alternative would be to write a letter to the FAA once again, attaching his order and informing him that the PIO is not abiding by his order. Request him to enforce his order and provide you with the information you requested.

It is experienced that FAAs do not provide time limit in their decision directing PIO to supply info. Thus PIO just sleeps for inordinate period. While writing to FAA pl also request him to initiate disciplinary/departmental action for not complying with order of FAA and dereliction of duties. U may send copy to Head of the organisation [Chairman etc]. Send copy to PIO. Things will move. There is long waiting period at CIC/SICs. This delay is indirectly compelling info seekers, who need it urgently to "BUY" the info!!!
