RTI helps septuagenarian get retirement dues

Last week a seminar had been organised as part of awareness programme on RTI laws in Bhartiye Bhasha Parished Hall Kolkata by an Urdu newspaper AKHBARE MASHRIQ and Moulana Shoukat Ali Foundation. Shri MM Ansari (IC CIC New Delhi)and Shri Arun Bhattacharyya(WB CIC) were present. Shri Ansari was a very clear in his speech and gave the audience to understand that mere imposition of penalty on the errant SPIOs was not going to serve the purpose of the aggrieved persons. He emphasised that the motive behind the law of RTI was transparency and eradication of corruption as well as to ensure that the justice is done to the aggrieved person. It appeared that he was sympathetic and also sensitive about the miseries of common man. On the other hand the West Bengal chief information Commissioner expressed his helplessness in doing anything positive as the government was not eager to implement the law with sincerity and honesty. The surprising factor was the West Bengal RTI Manch, who spoke before audience giving an incorrect picture of West Bengal information commission that only four appeals were pending for final hearing with the commission. This was absolutely incorrect. At least 12 of my own appeals are pending with the West Bengal information commission. So if the NGOs working in the interest of implementation of the RTI laws favour the commission then it can well be imagined as to what could be the fate of this law in West Bengal. 99 per cent of the West Bengal government departments have not complied with section 4 of RTI act. It has happened because of the soft attitude of the West Bengal information commission. My one of the clients has written to the Governor of West Bengal seeking his sanction to prosecute the public authority of Vigilance Commission West Bengal and the secretary and state public information officer of same department under section 166 of IPC as they have violated the provision of in their capacity as the public servants. Let's see whether the government grants the sanction not? This is a fit case for issuing direction upon the government and the West Bengal information commission to get the law implemented by initiating the action against the public authorities of the respective government department for not publishing the details on their Web sites as laid down in section 4 of RTI act.adil

It is very strange that in a State like West Bengal which has very high awareness of its rights (not withstanding the left) and which is known for its ability to fight, the latest Right to Information is not insisted upon!
