My EPF Problem

Sir,
I,Yogesh Vasant Patwardhan,residing at Pune,Maharashtra,was working with organization named 'Consulting Engineers Corporation (Pune office) till 23rd July-2003 as a Civil draughtsman (Employee code-CEC/PN/174).
I had filled up the EPF form (EPF No: DL-23003/174) first time when I left the company.But after 2-3 months later I have again filled up the EPF form on the request by the organization accounts representative (due to some mistakes in signing the form).
Now after about 5 years later I haven't receive any amount for EPF.Surprisingly some of my X-workmates from organization,who left the company with me,had got their EPF amount within 6 months.
I came to know that the EPF office for this company is located in Delhi (Nehru Place) and not in Pune,Maharashtra.
So how can I able know the status of my EPF account(EPF No.DL-23003/174) ??

Some facts I want to tell:
1) The company name has been changed since last 6 months
2) The saving account number I have quoted on my form to get credit is now changed to 15 digit account number since the previous bank has been taken over by another bank.

Now can anyone guide me on this case that wheather I can know status of my EPF account under RTI & when I will get credit of the my PF amount?

Hi JPS50,
I am now in process of sending first (simple) application to EPF Delhi as per guidelines you have mentioned in your post....Lets see how they reply...
Please suggest me any other precautionary steps to be taken while sending the first application under RTI (as per appendix B you have attached in that blog).....
If I will not get any answer on simple application within 1 month, I will send first application under RTI.
Is it ok??

Pl go ahead and in case U are not satisfied with the reply to even RTI application [if required to file], U can file First Appeal under RTI. Hi,
After not receiving any reply on 1st ordinary application, today I have send application under RTI as per the procedure you have suggested. Lets see what happens...
Documents enclosed with application:
1. List of required information
2. IPO of 10rs.
3. copy of 1st ordinary application
4. copy of acknowledgement of 1st application
5. copy of letter sent by the company to EPF office.
I hope the above documents are enough!

One more query--
Recently on Orkut community of RTI, I have read the following lines by one member.--
""Postal orders, though theoretically acceptable... are not the way to go-- as the application becomes valid ONLY after the same is encashed and the money deposited in the treasury. It is best to deposit a Treasury Challan of Rs 10 in SBI// district treasury.. under relevant head""

I want to ask you that how much true is this because I have send the 10Rs by Postal order only

As per his remarks, my application would become invalid if EPF office of Delhi will not encash the amount..
could you please guide me on this.....need to resend the application with treasury chalan of Rs 10??

No, your fear is unfounded. CPIO's 30 days time begins from the date he receives completed appln. Encashing IPO or DD is not of relevance. It is CPIO's headache.

I know you will be always there to whom I can ask quries/questions online, but if you know someone from Pune, please suggest me that name.
I have searched for it a lot on google, but unable to find the same so I asking you now.

Hi,
Today I have received a letter from EPF delhi office mentioning text as below.....

"Your appication dated 7/10/2008 received on the above subject is returned herewith remarks that postal order is not addressed in the name of competent authority i.e. 'RPFC Delhi(South)".
by
Sarojini Rane,CPIO."

Now I have some quries...
1. Do I need resend the postal order on the name mentioned in the letter i.e. 'RPFC Delhi(South)?
2. Sending postal order only on the name 'RPFC Delhi(South)' is suffuciant?? Or need to add more details??
3. There are no suggetions in the letter that you should resend PO to above name. So do really need to send on 'RPFC Delhi(South)' only?
4. Don't they revert the previous paid 10 rs for PO again for new PO? Is it like that I have lost first 10 rs?
5. Now, do I need to send it as "First appeal" or again consider as the first application seeking information??
6. They have send me photocopies of the set which I sent earlier....what does it mean? Not a single remark on any photocopies.
7. Now can I send application (or 1st appeal?) on the name of Sarojini Rane? I am asking this since first application I sent on the different name i.e. Mridula Ghai which was available on their web site.

Could you please guide on above queries at your earliest convinence so that I can proceed further to resolve this issue as soon as possible?

Please send new postal order for Rs.10/- in the name of "RPFC DELHI [SOUTH]" and resubmit all the papers [i.e. original rti appln etc]that he returned to you, with a covering letter giving ref of CPIO's letter. You should always address person in his official designation as CPIO, since officers get transfered etc. U need not file first appeal now. If you do not get reply within 40 days of mailing new postal order, proceed with first appeal.

4. They should have sent back your 'invalid' PO. You can ask for it. In whose favour did you draw the PO first? Refer to DOPT circular dated 1.4.2008 available in the site Right to Information Act (India). If you had drawn it in favour of the Accounts Officer they should not insist you to draw it in some other name.
5. No need for appeal at this stage.
6. Send it to the current name of the CPIO. They keep changing.

U can draw attention of CPIO in your covering letter to circular No. F No. 1/2/2007-IR dtd 23-03-2007 of DoPT, Govt of India regarding payee of IPO, if you have mentioned 'ACCOUNTS OFFICER, EPFO'. The circular is at DoPT Circular re designation of PIO/Mode of payment/Cheque in favour of/application format.

I sent the previous PO in the name of "accounts officer" only....but they havent accepted it anyhow....so I am resending now the total set of documents with a covering letter as you have suggested in which I requetsed them to revert back the 10rs paid for previous PO. Also I have given the reference of the goverment circular no. as you have mentioned in your reply. I think the one suggestion from orkut member "to deposit a Treasury Challan of Rs 10 in SBI// district treasury" is valid in my opinion because of this incidence.....what say?

If CPIO is to play delaying tactics, he will do in case of challan etc. He will find out some other defect. Such operational problems do arise and we have to overcome them, as officers are finding it difficult to adapt to new regime of openness and accountability. At least U are lucky that CPIO says he has received IPO. Pl refer following thread:

oh....yes...tactics played by them really.....also as in my case, I have nothing to prove with IPO.....only a photocopy which I have in my file
I dont know really, but is there any way to get receipt of the IPO as we do get for speed post? Coz for the previous IPO, I havnt received any receipt to till date....or is it like that if they havent encashed it I should not get any recepit?
Also, just for your information, for both communications I have done with EPF office,delhi, I haven't received any Acknowledgement from post inspite that I paid 10rs extra for the AD couple of times. So I lodge a complaint at both the times to the concerned post office for AD....& both the times post office provided me a letter in which they have certified that the documents were delivered to the delhi address.....but AD is supposed to have sign & stamp of the concerned authority......I raised this point also, but they said you can stand with this letter in any legal case....I doubt how much true it is ..So it was like "case in case" for me to tackle with typical goverment process ..Also I have posted a complaint against Speed Post department that why should not I demand to revert back extra 10rs paid for AD for both speed post i.e. 20rs.....now I have 2 cases to wait for reply...one is RTI & other is Post

....ok...fight & fight...that is the only way....what say?

1. The IPO has a counterfoil which you can fill up and keep as proof.
2. The procedure to find out if your IPO was really encashed by the PIO or not, is very lengthy. No point even trying to get that information.
In any case you will achieve nothing by following that route.
3. The letter from the Post office that your registered letter AD was delivered on a particular date to the addressee is proof enough that it was delivered.

yyp1976, life is not that easy. RTI has at least given you the chance to fight. Without it, you wouldn't have even got this far - would have in fact given up much earlier.

Hi JPS,
Today I have received one document via speed post.....please see the attachements.....
I am unable to understand the exact purpose of sending this document to me..whatever I can read from this typical goverement letter that this is nothing but the CPIO has send some instructions to the concerned PIO of Delhi APFC....please correct if I am wrong.....

I am unable to understand:--
1. Why they sent me this copy of letter which CPIO sent to APFC.....does it to show the applicant that work in progress on his/her application?
2.If they are sending this to APFC, why they need to mention all the acts again & again inspite that they already should have know this?
3. Importantly, is APFC is related to Information office or anything like that? I really dont know about it at all. Could you please describe APFC??
4. They have send me back the "Postal Order" which they denied to accept and I sent again new PO on the name thay have suggested. I asked them about the previous PO in the covering letter & also attached a copy of goverment circular you sent me. But they have only sent the PO, and nothing is mentioned in this letter. What to do with this PO? Would I get back the 10rs payment if I go to the post office with PO?
5. Am I able to get the required information withing 7 days as per their instructions in letter (see last para of point 4)
6. I always send the letters on the name of Mridula Ghai (this name is available on EPF web site). But couple of times I get reply from Sarojini Rane....why is it so? Should I not get reply from the person to whom I send letter?
7. Could you please explain in brief about the "Appellate Authority"?
They have mentioned name and address of this at end of letter.

What I can judge from this letter that my case in progress at their end

..Please correct if I am expecting too much

presently i m on tour hence i m unable to access net. APFC is asstt. pro. fund. commissioner and matter may be relating to this apfc i could not access attachment and hence i request you to reproduce verbatim in deleting personal info if any. i think your case is being attended to. pl never address in personal names of officers as they get changed/transfered etc. always address in official designation. if u do not get reply in 15 days file appeal by refering to my blogs.
