Question: Seeking names and phone no of accussed from the court- does this amount to third party info

I intend to seek the phone no, name and address of accussed in certian type of cases say for e.g. all RAPE cases going on in the court.

Can the PIO of the court deny the same on following grounds:

1) The information sought is personal information of third party.

2) The information cannot be given as the case is under Trial/invstigation

3) It is a threat to the life of any person

If your answer is yes then what is the best way to dodge the PIO while drafting the applciation so that such type of replies dont come up

Sir, you have correctly identified the information as third party information. Only the name and maybe the address of the person can be revealed to you. No information which has been made available to court under confidence can be revealed. Thus you should be able to get the name and address but not the phone number.

Alternatively what can be done is, ask for copies of the FIR or DDR or the complaint which was filed in such cases. Most of these would contain details of the rapist address.

Also, information pertaining to case undergoing public hearing might not be deniable, but I'm not sure. Could a lawyer member please comment on this?

by the way i am not from "Rape the Rapist" group. I am from the "498A cause sowry sowry causes dowry" group. You will find the meaning of Sowry in wikipedia.

Well dowry means what a woman brings in her marriage to her husband

and sowry means what woman demands from her husband by filling false dowry cases on him.

both dowry and sowry are a menace in our society.
