    FORM 16 & SALARY CERTIFICATE
    I both of these are personal information or not? Employer can give FORM 16 to anybody ifno than give me link ofthis type decicsion

    Is the employer a "public authority" as defined in Sec 2(h) of the RTI Act ?

    Employee is a lecturer in govt college. inlaw filed false 498A against him nad know want form 16 of income tax

    If it is a Government College, then the salary details have to be declared suo-motu under Sec 4(1)(b)(x).
    Why do you want to get into hassles of Form 16 at all ?

    My in law filed false 498A case against me now they want my form 16

    They can access this information easily, as the college is under obligation (under sec 4 of RTI Act) to publish salary information of all its employees.

    Has the PIO sought your comments (as a third party) in writing ?
    If yes, then you can just reply back saying that your salary details have to be suo-motu disclosed under Sec 4(1)(b)(x) of the RTI Act.
    The applicant can be asked to check the Sec 4 disclosure of your college.
    If your college has not made this type of disclosure, they should do it now, since they were supposed to do it by 12th October 2005 - more than 5 years ago.
