Documents related to disciplinary proceedings

In a recent judgment, the Madras High Court has ruled that documents related to disciplinary proceedings can only be disclosed after hearing third parties.

The PIO and FAA of the SBI had rejected the RTI request of the applicant to disclose these documents pertaining to disciplinary proceedings against 14 officers on grounds of 8(1)(j), no public interest involved and third party information. Matter went up to CIC which ordered the disclosure of the information.

The PIO and FAA approached the court arguing that the CIC had not followed the procedure as prescribed in Sec 19(4) (hearing third parties before passing orders).

The court remanded the matter back to the CIC for fresh disposal of the matter after personally hearing the 14 officers (third parties).
