dear members, after the FAA has passed order in favour of the CPIO, can the appellant ask the FAA to review its decision/orders (after specifically pointing the errors in his decision/orders) ? |

sir, there is nothing in the RTI act which forbids such a move; any fair minded FAA would correct himself if his errors are pointed out; however, the tone of the letter would decide whether the advice would be taken in the right spirit |

If there are errors in the order of the FAA, then please send him a letter pointing those out and request him to review his decision. Please also mention that under Sec 19(3) you will have to proceed for Second Appeal if the errors are not rectified at the FAA level. |

As brought out earlier, power to reviw and correct errors apparant on the face of records suo moto or on application is an inherant powers vested in every Tribunal or judicial or quasi judicial authorities.This is a provision of Order XLVII Rule 1(1) CPC 1908. Even the CIC has issued amendment to his Management Regulation 2007 restricting his power to review only to the above error apparent on the face of records. I don't think of any problem to seek review on such aspect. Review of the merrit of the case is not allowed normally. |
