Need Help: Please help me

Hi all,

I am in big trouble. I would request you to please help me. One corrupted under secretary had ruined my life. Uttrakhand police is registering false complaints against me under the influence to this under secretary and chasing me for arrest. I have complained to all authorities but didn’t help. I am having personal issues with this under secretary.

Bit brief about this under secretary, he was under secretory with uttrakand governemt. He, then Under-secretary (Home) in Uttrakhand govt., was suspended on 22-1-2009 by chief secretary Uttrakhand when he was caught red handed with temporary police women in a government vehicle. He was drunk and was sexually harassing this temporary police woman. This woman was posted in uttrakhand secretariat. Even government vehicle, he was using, didn’t belong to him. He got this vehicle by using his power. No vehicle is provided to him by government. He was suspended and responsibility of investigation was given to R Minakshi sundaram, upper secretary Home, Uttrakhand govt. After complication of investigation, investigation officer found all the allegations true and presented the chargesheet on 05-02-2009. Since April 2010, I am asking detailed documents related to above investigation under RTI Act 2005 but nothing was provided to me by secretariat. Two months back two women contacted me in dehradun court and handed over the documents (copy of chargesheet with other various orders) related to above investigations. Both are working in Uttrakhand police and told me that both are being sexually harassed. They informed me that he has being reinstated again as under secretary uttrakhand.

I have provided the events details below.

Events:
17-4-2010, I filed the RTI in secretariat for asking the information regarding his suspension. On this, information officer took the decision to provide me the information but give chance to under secretary to go for first appeal.

May- 2010: decision on under secretary’s first appeal
First appeal decision was, information should be provided but again give the chance to under secretary to go for second appeal. Under secretary said that it is his personal information and this information shouldn’t be provided under RTI Act 8(1)(j). But first appeal decision is “the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person” so information should be provided.

6- Oct- 2010: under secretary go for second appeal in Uttrakhand Information commission
Here under secretary used his contacts, till January this appeal was even entered in to then system. When I made may calls and escalated it to media then I was told that date for hearing is 8 Feb. No formal information was provided to me on this.

17- Feb- 2010: today I have received a letter from Uttrakhand information commission that on 8 Feb, no decision was taken because I was not appear there. Next date fixed is 7 March and I need to appear.

In this situation it wouldn’t be safe for me to attend the date on 7 March.

Could you please suggest me what should I do? Also please suggest me few decisions taken by CIS or state information commissions for such appeal that can help me.

From what you have mentioned , I do not find anything that should scare you that much . Donot be panicky , these problems are part and parcel of RTI use and activism . The Information Commission has been rather considerate enough to give you another opportunity to represent your case . So avail of it and appear before the Commission . The PIO and FAA have provided opportunity to third party as per s.11 , whether using s.11 in this case was right or wrong , has to be decided by the Commission . You need to have some citation where the proceedings of departmental Inquiry (findings given) have been ordered to be supplied to applicant by the IC or by some High Court . Search here :

But Sir , He has written that police is behind him to arrest. I think matter is serious. First of all we all should ensure his safety.

If the police has registered a case - false or otherwise - it can not be tackled by running away . He has to prove his innocence . Running away will go against him . He should contact some NGO / Media / competent advocate .
