Non payment of society maintenance charges
We are a commercial co-op society and have defaulters who are not paying up maintenance charges even after repeated reminders. We even have sent letter to the REGISTRAR OF socities> What action can be done against this erring members......

You can file a suit for 'Recovery Certificate' u/c 101 of MCS Act 1960 inthe office of Dy Registrar of your ward.
Details related to recovery suit can be obtained from Dy.Registrar under RTI

For Recovery of Maintenance Charges Society has to file Suit in Co-operative Court. Deputy Registrar have no power to recover Amount. He can only issue Notice.
For Filing Suit Committee Members must have Given Indemnity Bond Form M-20 to Members Since October 2007. If they have not given M-20 Bond then they have no right to Issue Bills as Committee Stands Illegal and Unauthourised without M-20. Legal Suit Cant Stand in Court without M-20 Bond if Member Takes initiatives.
How a Illegal and Unauthorised Committee can Collect Money from Members coz Members dont know where their Money is going ??????
