    indemnity bond

    dear friends

    whom should i apply to get the details about whether our managing committe of our cooperative society have subnmitted indemnity bond. we stay in andheri mumbai.
    also if you can help with in what format should i apply to the concerned authorities it would be of great help.

    Also pls beware that the department of Co-operative Societies in one of the most corrupt departments.

    While filing a complain to the deputy registrar against managing committee members for not having executed indemnity bond u/s 73 (1AB) Rule 58 form no.20.

    There are two provisions to be taken care of by the deputy registrar before issuing order u/s 78(2) of the Maharashtra Co-op Sty Act, 1960 for dismissal of the managing committee:
    1) He has to satisfy himself that the managing committee members have not filed indemnity bond within 15 days of assuming the office.
    2) He has to take Federation's opinion.

    He will carry out the first part of the provision and deliberately ignore the second provision.

    His senior will then issue a stay order, which will go on for ever and the managing committee will continue to function as normal under the stay order.

    So when you file a complain ask the deputy registrar to cover both the provisions.

    The registrar has the discretionary power to either appoint a government servant as an administrator or alternately appoint three or more members of the society as administrators other then the current managing committee while dismissing them.

    So ask for appointing members of the society as administrators.

    Exclamation hello..need information

    Hello to all & Compliments of the Season!

    The managing committee members of the housing society I reside in do not seem to have executed the indemnity bond after after taking charge of the office (registered since 2006).

    I wish to make an application to inspect the indemnity bond (if signed at all) . Can somebody help me with a sample application/ form to file under RTI with Deputy Registrar Co-operative Societies?
