    Default consumer complaint for deficierncy in service rti act


    usually for filing a complaint at a consumer forum,one should have original receipts with him.

    in the case of rti applicants, it can be bank counterfoils or counterfoil of postal orders. In case of court fee stamps,no receipts are available. At any case usually,people may not keep these records with them.

    In the absence of such records,what records to be produced before the CDRF to prove that the nec essary fees for the information was paid?

    In case of court fee stamps,no receipts are available. At any case usually,people may not keep these records with them.
    After affixing the same one may get the photo copy of the application & it can be used for further purposes. Processing of application also means that fee was properly paid.

    dear Ambrish,
    thanks for the reply.

    May be You have not got my question proper.

    At the time of sending an RTI application,maximum record usually kept is a copy of the same and the receipt for sending the same. No body(I am one among them) usually forsee the need of filing a consumer complaint later.

    In short,If you have only a copy of the rti application,a reply from the SPIO with incorrect information and the postal receipt. will these things sufficient for filing a complaint at consumer forum?

    Can somebody share their experience of filing consumer complaint in this regard?

    Dear Member

    Options:

    a. Either pay the fee in cash against proper receipt.

    b. Or file another RTI application seeking details of the previous application.

    If PIO has not raised the issue of RTI Fee in his reply , it can be safely assumed that RTI Fee was paid adequately and was accepted . These two documents are enough in your circumstances to file a consumer complaint ... but the outcome will depend upon merits of RTI Appl / Reply of PIO .

    If the reply has been received from PIO without any objection on fee, than there is no dont have to produce any proof of dispatch or postal order.

    I have never experienced in consumer forum, but have always used this rule while filing my first and second appeal.

    Hey looks great idea!! Are you all saying that we can file consumer complaint if PIO donot provide adequate information after accepting Rs 10 ( fee of application) or you are saying that if PIO fails to provide right documents against fee asked by him?
