members, please go through this order of IC Padma, delhi http://cic.gov.in/CIC-Orders/PB-23092008-06.pdf The CPIO has shown a reply given to the applicant vide letter 12.8.2008 for the application dated 14.9.2007, which means he has given reply after a period of more than 10 months. Though the RTI Act contemplates imposition of maximum penalty of Rs.25,000/-, since the CPIO has submitted during the hearing that he has not received any of the communications which were sent to his office and these were rotated among different Dealing Assistants, I take a lenient view in imposing a penalty of Rs.5,000/- for committing such lapses under RTI Act. I also direct the CCIM to recover this amount in two installments from the salary payable to the CPIO from the month of October, 2008. After effecting recovery, the CPIO has to file reply to the effect that the CCIM has carried out this direction of the Commission. On these lines, the appeal is disposed of. either the penalty should have been imposed in full or else they should have pardon the CPIO(by not imposing any penalty), in the usual way. in this way IC has initated a new way of discouraging the appellant and encouraging the PIOs. |

u r right to say so. but before this the CIC, Delhi never negociated the penalty amount. either the penalty was imposed or it was not. but from now we may get to see no. of such decisions. |

| What a shame. I think the Hon'ble Commissioner has taken a clue from the U.P. State Information Commission, who never impose Penalty. |
