I have aflat in Orlem Park View Co-op Hsg Society Ltd Tank Road Orlem Malad West Mumbai 400064 Reg no BOM/HSG/5851 dt 11-5-1979. This society has no conveyance on its name. Can I go for the Amnesty Scheme 2008. The flat was purchased by my moher in the year 1978 who has expired and I do not know if she has registered the agreement of sale as I have no record of it.The flat has been transferred on my name as a single nominee. The share certificates are in my nameand so also the outgoing bills and the electricity bills in my name.PLEASE GUIDE ME IN REGARDS OF THIS MATTER. THANKING YOU |

Dear Periera, Conveyance of the society's land and registration of your flat's agreement are two seperate issues and are not interconnected. Please refer to your agreement copy entered into between your mother and the builder to find out whether your agreement is registered or not. If you do not have a copy of agreement for sale, please contact a agent who deals with the registration of agreements for sale for further assistance. You can find the agents by searching for them on Google |

You can contact other members of your Society to find out what they have done in this regard. The Builder/Promoter can also help you. The Agreement for Sale always has at least two sets/copies, one each for the buyer and the seller. Approach the Builder to get a copy of the set in his possession. |

hi malcom as u have mentioned that your mother had purchased the flat and on 11-5-1979 and has expired, and u are unable to check if the agreement has been registered or not, here is how u can check that out: 1) If the document is registered then it will have the Registrar's stamp with a minimum registration fees stamped at the end of the agreement. 2) If the stamp is not there then the document is not registered and for that U have to now pay the stamp duty in amnesty scheme If u do not have the agreement with u then tell ur society to give u an allotment letter on the society letterhead that the flat was purchased by ur mother from the builder or the seller which will be accepted by the registrar on absence of the agreement. Either u can give the document to the agent or u can can go to bandra stamp officee and submit the documents. If u are thinking of giving it to an agent then he'll give u all the infomation about the documentation. The charges of the agents are Rs10000- to Rs15000 for stamp duty and registration. If u are not willling to pay the agents the amount then u can submit the documents on ur own which is not a big thing . On submitting the document u will get the demand note in a month from the stamp duty office to pay the stamp duty.The stamp duty for the flat purchased on 11-5-1979 will be 10% of the agreement value + Rs500 penalty charges if the agreement value is less than 50000. If u are paying the stamp duty on YOUR OWN do not forget to stick Rs10 court fee stamp on the form take an acknoledgement on the xerox of the form as it will be easier for u if u don't get reply in 30 days.
