    Default Defination of privacy/personal information under RTI Act...


    Can u plz tell me when i ask xerox copies of leave account register & attandence register of all 150 employee of a Govt orgnisation , the office replied that this is the matter of privacy of employee and such kind of personal information cannot be given to you, please tell me is it correct. and also define privacy and personal info under RTI act

    Leave account and Attendance register are not personal information.

    Personal information is those which have no direct relation with any public activity. When maintenance of leave account and Attendance Register are public activities, in terms of instructions of rules in force, those items are public documents and in public domain.

    Moreover, the PIO can deny information only under any of the clauses under Sec-8 & 9.
    Denial of Leave Account and Attendance Register are not hit by Sec-8(1)(j) of the Act.

    Dear Vimal

    a. Information can be denied only if it falls under sec. 8 or 9. The PIO cannot simply refuse information. PIO has to explain how a particular information would fall under any exemption clause.

    b. Leave details /attendance register is not personal info.
    Leave application submitted by a public servant before the Public Authority is a document exempted under Section-8(1)(j) of RTI Act, 2005.

    CIC (SG) in decision no. Decision No. CIC/SG/A/2010/000505/11673, Appeal No. CIC/SG/A/2010/000505 had given a landmark decision under which the leave details as well as leave application cannot be denied. Hon'ble IC had made the tenet very firm with well reasoned order, a copy which can be accessed in this link posted by Karira:

    Hon'ble IC had well traversed the ground raised by the PIO and reflected in your query. Please read the full test of the IC (SG) decision and proceed with appeal, making use of the grounds reflected therein.
