I have framed the introduction to RTI and questionnares for the War Hero who died fighting militants in Valley. His wife was not getting Ex-gratia of Central Govt due to her. I fought her case and she has paid Rs 7.5 lacs. It was not credited to her account due to fault of Pension Disbursing Officer or bank. Now I want to help her with interest due to her. After all he laid his life for this Nation. I have framed an RTI. Please refine it so that she gets her due. The main contents of application are:No 14913230 Late Hav Charan Singh of Rastriya Rifles died in encounter with Militants in Valley while on active duty on 05 Dec 2005. The individual was declared Battle Casualty by Army. Ms Surjit Kour Widow of Late Hav Charan Singh was released Ex-Gratia Grant of Central Govt vide Pr CDA(P) Allahabad Pension Payment Order No – F/BC/005099/06 dt 03 Apr 06. However, the amount was remitted to her account on 14 Jul 2008 after a gap of more than two years and three months. This was done after repeated reminders to all concern and almost fifty visits to the bank. The widow was humiliated by the bank and refused to entertain her request. The bank has also refused to pay interest at fixed rate due to her from the date of release of payment (03 Apr 2006) to the date of remittance (14 Jul 2008). This amount works out to be almost Rupees two lakhs. This is gross injustice to the kin of Non-Commissioned Officer who laid down his life fighting for the country. I would like to know the following (a) Who is responsible for ensuring timely credit/ remittance of Ex-Gratia to the War Widow? (b) Why ex-gratia was not remitted to her account immediately on release?(c) Who has cheated her? Is it Pr CDA(P) Allahabad, Regional Pay Disbursing Officer or State bank of

'Information' is distinct from 'Question', though a slight manipulation of language can turn the each into the other. RTI Act cover 'Information' but not 'Questions' or 'Opinions'. For example:
Question: Whether is true that an amount of Rs. $$$ received under scheme XXX was fraudelently disbursed to some individuals.
Information: Please provide me a list of all beneficiaries, along with the amount disbursed to each of them, of the funds received under scheme XXX.

same:Please provide the details( name, designaton, office add., office telephone no. & moblie no. if provided by office) of officer responsible for ensuring timely credit/ remittance of Ex-Gratia to the War Widow.

RTI Act itself do not solve any problem, but the information obtained through it can be used through some other channel

Jaswant Singh,
We do have a reasonably good Defence Accounts Department and willing staff in other concerned departments of the Ministry of Defence that it is just not possible for the incident as narratted by you to happen. Unlike civil departments the Army units does not leave things like that. It is just not possible that the Rashtriya Rifles, the parent unit of Haw Charan Singh is silent.
The truth maybe entiely different. In such cases invariably there are rival claimants and the banks are put into trouble. But Rashtriya Rifle could and will sort out all such problems. If you are willing to help the widow, please fix an appointment with Rashtriya Rifle Unit, and take the widow to the OC, Unit. All the problems will be sorted out unless there is something fishy.

Dear Jaswant, please do as advised by Col in the post above.

While drafting your next RTI Application add a line for File Inspection and taking copies of Records etc. Then only you can get a complete picture.

Strive your best to resolve this issue and let this lady get her dues. Plz don't leave it halfway.
