Faa has asked me to come after the stipulated time period is over but before second appeal filed . Should i go?

Dear sir,

the time limit for the faa to reply to my appeal was 10th may 2010.

The second appeal has to be filed by august 8,2011.

The faa has however called me in writing for an appointment on august 12,2011 which is outside the time limit of replying.

My queries:

1. Should i meet the faa and would the time for second appeal count 90 days after aug 12,11

2. i propose to send it by speed post to sic, which is locally situated, on aug 8,11. Would this be deemed as received within the time limit.

Generally it will not. You are signing and posting it in time. Even if FAA reject it on that ground, we will have a ground for Second Appeal.

FAA can decide the first appeal within 30+15 = 45 days. There is no provision under the Act for a personal hearing by FAA. If you don't appear, FAA would reject the appeal on that ground. If you have no intention to appear, you may immediately advise FAA by Speed Post, advising that you have already submitted your appeal with grounds and pleadings and FAA may give his decision based on that.

a. If FAA has taken more than 30 days in passing decision, s/he needs to record the reason for delay.

b. In your case time limit will be within 90 days from the date of hearing notice from FAA and if s/he passes any decision on 12th Aug. then 90 days from the date of receipt of that order. You can calculate 90 days accordingly.

You can file complaint u/s 18.1 which has no time limit.

File Second Appeal in time mentioning failure of FAA to decide First Appeal within stipulated period. Send copies to PIO and FAA so that it reaches them before 12th.

You have no obligation to attend First Appeal hearing after filing Second Appeal.
However, in your own interest, better attend the hearing and bring the proceedings/ outcome on record as an Addendum to your Second Appeal filed before SIC.
