Addtional Commissioner of Delhi Police fined Rs 50,000.00

The PIO of Police Headquarters, Delhi Police, Addnl. Commissioner Mr. Dipender Pathak has been fined a total of Rs. 50,000.00 for two different matters - the maximum penalty of Rs. 25,000.00 in each case has been imposed by the CIC.

The PIO was given sufficient chance to identify the people who were responsible for the delay, but this was not done. Neither did anyone give a written reply to the CIC nor did anyone appear in person to clarify the issue.

The Central Information Commissioner (CIC), Wahajat Habibullah, has slapped a Rs 50,000 fine on additional commissioner of Delhi Police Dipender Pathak for not providing replies to an application under the Right to Information (RTI).

On Tuesday, the CIC found that Pathak, public information officer (PIO) of Delhi Police, had failed to give reasons for not providing correct replies to an RTI application and also did not appear before the commission.

“Neither have we received any written reply nor has he (Pathak) or the errant police officials appeared before us in person,” Habibullah said.

Earlier, Prashant Garg, a resident of East of Kailash, filed RTI applications on the shifting of a bus stop from E-11, East of Kailash to E-23. Garg alleged the bus stop led to traffic hazards, causing two major accidents.

Garg sought the reasons for shifting the bus stop from the traffic police. But it failed to reply satisfactorily, despite an order of Delhi Police’s appellate authority for RTI applications to provide point-wise reply to Garg’s questions.

Habibullah gave seven days to the PIO to provide information. Garg said the information provided was misleading and, therefore, the PIO should be penalised.

The CIC then asked the erring police officials to appear before the commission to explain why a penalty should not be imposed on them. But the police officials failed to appear, which led to the decision to slap the penalty.

The CIC also asked Commissioner of Police YS Dadwal to deduct the penalty amount from Pathak’s salary from November onwards.

This is because there is no any administrative disciplinary action . Due to such reasons corrupt and bribe-takers have propagating that honest employees are hopeless and taking shelter pfrom politicians . Neither IAS or IPS takes disciplinary action against employees for them there are public complaint/s . IAS serves related to land and Revenue there is large section of bribe and corruption , for this mild work area complaints and complainants remain dormant and they enjoy on the cost of public .

though it is late but good .
Hope Commission will understood dificulties of public/applicants that they are being harased deliberately by PIOs .
Hope Commossion will grant compensation with all expenses to the applicants on the course of Information HIde .

this is my first day - thanx for the fuel ,energy by this report , I also think that RTI don't have any power infront of these officers -bigbosses of delhi

With help of this section all political parties enjoying on the cost of public . These IAS and IPS were powered by Britishers to create terror among public by making and implementing laws and rules . Those are exixting in free Democratic India . There is well protection by law to them . This penalty is not to an individual it will be debited/compensated by Depptt/Organisation in the name of PIO . Due to this reason PIOs are very deliberate to harass public variously and hide/twist information knowingly . This Group of Public servents having special powers and our public representative propagate that they succeeded by trasferring someone insted of making system of punishment and trasparent action to be displayed publicly .
There is a wide range and broadly movement is required to change in law with consent of social activists and other non government intellectuals/ wise , aware persons to keep control on such powerfull class of employees to be sensible and public oriented in place of favourism , powerism away from political hands .

50,000 fine is welcome step.. can we enclose copy of this order along with our RTI application so that PIO's will get advance warning that if they fail tp part with info rmation they too may get the penalty.

That would be irrelevant.
PIOs have their own way of knowing these things. No need for such a thing.
