Faa should also be given power to impos penalty upon spio and penalty should also be imposed on faa


In routine it is seen that spio is not having proper knowledge of the act due to which information seeker has to suffer and FA is a barrier in getting information timely as it gives unnessary time to pio in this way FAA should have power to impose penalty say Rs 10000/- on spio so that the rti act can be implemented more powerfully

FAA should also be fined by Commission for if FAA is not able to get his orders implemented

Changing the law is time consuming. However IC can recommend departmental action against FAA for flouting a law i.e. RTI Act. It can also recommend adverse remark in personal records of FAA . It can pass strictures against FAA and send copy of the order to head of PA. It can order FAA to share compensation/damages [not penalty which is only for CPIO ] to be paid to applicant.

Of late, it takes several months for a second stage appeal to be decided for the sheer fact that a huge number of appeals are filed in the CIC. The FAA having given no power to impose penalty on CPIO /SPIO, the information seeker has to wait several months before his grievances are redressed and information provided. In this perspective, the very purpose of the RTI Act is defeated as the bureaucracy is yet to come out of the Colonial culture of secrecy.

Dear Advocate Rajesh,

FAA is usually the PIO 's boss or boss's boss. He hardly needs the threat of penalty to enforce compliance from his own subordinate. The problem isn't that FAA 's are unable to control recaltricant PIOs. The problem is that FAAs act in collusion with PIOs to deny Information .

you are very right someguy, now it is the need of the hour that some effective changes in RTI are needed because the PIo 's and FAA have started playing with the Act and a conman man is not getting relief quickly rather he sit at home now instead of following his application as the PIO know the limits of a common man.

The failure is that instead of two levels of Appeals, there is effectively only one - with the IC - which means 5-10 individuals have to hear appeals from the whole country or state. Plus, they rarely enforce even the mandatory punishment provisions.

The first appeal should lie with an authority outside of the PA in question, i.e. someone who is not an interested party - either due to concerns of having to work with the PIO in question, or because of any illegalities, the commission or concealment of which s/he might be complicit in.
