Dear Dr. Kushal Pathak, I come to know about this site today only. In most of cases, the concern officer or replying authourity is refused to take rti and bouncing on other departments. some type of organisation should be formed, city wise with a team of desositing application and take nececcery action against who are not acception application of rti, it should be compulsory to make note on application why they are not acception. and sign boards should be displayed in the offices of all departments like board put by anti corruption department in all govt offices. |

Please go through the posts. Non-acceptance of RTI application is not a problem at all. All that one has to do is to write boldly at the envelop indicating that it as an "RTI Application" and sent it by Registered post or speed post. If it is not acepted by the addressee, the postman returns it writing on the envelop " Returned due to non-acceptance by the addresee". This is good enough ground for appeal considering that the information sought for is deemed refused. Why do you want an organisation for this ? |

But since most of the departments, specially the state governments have not yet nominated PIO and you dont know whom to address your application. What should you do in that case ? Most of us are not cognizant of organisation setup of the departments. And most confusing is addressing of IPO/IPO. Whom should you address unless you know the account head of the department concern. A person visits a department holding an application to know about the person whom he should address the application and the draft. Even after three years, most of the department have not yet complied with section 4(b) of RTI Act. RTI clearly states that PIO should render all the assistance to the appellant, but instead of assistance they only provide resistance in almost all the cases. Certainly there should be some department where people can approach with their grievances. CICs are too busy and take years to solve it.

I suggest you to go through the posts of this forum The issue has been discussed in isolation as well as with other issues. Still let me repeat for the sake of those who came late: 1. Make an application requesting the State/Central Public Information Officer for specific information 2. Enclose crossed blank IPO for Rs.10/- 3. Address it to "The State or Central (as the case may be) Public Information Officer, the Department concerned, its postal address (Please don't make any mistake in this) 4. In the envelop write it boldly "RTI Application" 5. Send it by speed post 6. If returned undelivered, see that the postman has endorsed "the reason for non-delivery" with his signature. Enter date and time of delivery correctly.In case the envelop is found tampered with, please take open delivery recording in the receipt about the tampered condition of the returned envelop. The reply is likely to be "addressee not existing" or "addessee refused to accept". In both the cases it amount to non-existance of PIO or the PIO's deemed refusal to accept the RTI aplication 7. Prefer a complaint to the Central Information Commission or State Information Commission" under Section 18(1) of the Act. Any doubt please ? |

Dear Shri Karia, 1.As per the provisions of the Act under the Proactive Disclosure,every Public Authority should have PIO ,APIO and Appelate Authority and they should publish the same. 2. In case of refusal of the RTI application,you can opt for Appeal to the Appelate authority of the concerned Public Authority OR directly Appeal to the SIC of the State with necessary proof of denial. 3.I am sure it should meet justice. |

Do you mean to say that your RTI application was forwarded to another department? In that case you should try to find out who the appropriate PIO is to handle your matter. File your application to the PIO of relevant department to avoid delay. |

Unless and untill SIC's / CIC's are sincere, PIO's and AA's are going to be casual and play around. Just one Benevolent person at the top has changed Singapore. SIC's and CIC's are at the helm of the RTI Act, only their sincerety can help RTI Act being impemented in true spirit of the Act. Nevertheless Right To Information is a great concept and has to succeed eventually.
