Friends :-
If a spio or cpio without giving demanded information with in stipulated time and after 2 or 3 months get retired from services can commission impose penality on him . If the final appeal is in my favour.

If the retired PIO is proved to be guilty then penalty can be imposed. The penalty under RTI Act is personal in nature and is imposed on any person who is guilty of giving false or misleading information or delaying information . The penalty can be imposed even if the guilty person is not a PIO . Therefore it should not matter if the PIO is retired.

1. YES.
2. Irrespective of the retirement,the onus of providing the information was with the PIO at that point of time when he was PIO .Now, if it is revealed and found that the the PIO has not given any info. as per the RTI Act in the stipulated time the SIC/CIC as the case may be, can impose penalty /fine as per the gravity of the case and as found appropriate by the SIC/CIC.

There are several instances at CIC and a few at SIC (because they seldom impose Penalty ) where orders have been given to deduct the penalty amount from the Pension of the retired employee.
