hello sir, my name is srinivas koyyana i am 32 yrs old and working for AIR INDIA mumbai basically im from visakhapatnam in andhra pradesh i need your help regarding..... in visakhapatnam my grand mother( father's mother) and her brother jointly purchased a land of 70cnts (3360sq.yrds.) in 1959. after her death in 1972, my grand father and my grand mother's brother made a partition deed in 1972. the whole property was divided into 6 plots out of them 3 plots were my grand fathers and the rest of them were my grand mother's brother's. their 3 plots were sold out and ours 2 out of 3 were sold out and sale deed of the concerned plots were with me the problem is with the 6th plot which is measuring about 380sq.yds. the plan of the plot is such as like 40feet road is adjacent to our plot which is measuring about 200sq.yds. that 40ft road has not been layed by muncipality now strangers had made a wall with gate in that govt land and the way to my land has been obstructed in this connection i would like to make a complaint against the whole scene please guide me how to approach for right to information act regards |

U shoud make a written complaint to the Municipal Corporation with photoes and if possible a panchnama describing present status. If the Corporation does not act within say 30 days, file RTI appln by refering to my blog at http://www.rtiindia.org/forum/blogs/...ding-govt.html. U have to follow AP RTI rules as to format and fees. Rules are available at website of State Govt or AP Information Commission.

File complaints at police station and with municipal corporation. However, you may have to take legal help and file civil / criminal writ / suit before the Court. I don't feel the authorities like Municipal corporation or Police will help you. Police will say it is a civil case and Municipality will say it is a criminal tress pass. Thus both of them will play football with you. Best option is Court of Law, I feel. |

U can use format of central govt available at http://www.rtiindia.org/forum/blogs/...govt-info.html, by changing CENTRAL PUBLIC INFO OFFICER TO STATE PUBLIC INFORMATION OFFICER, MUNICIPAL CORPORATION, VISHAKHAPATNAM. U have to enclose bank demand draft for Rs.10/- in favour of Accouts Officer of Municiapal Corporation payable at Vishakhapatnam. Pl mention exact name of the corporation, as different places name corporation differently. U can visit website of the corporation-RTI icon for guidance, if such a website is available.

My humble suggestion is to follow this path: Ordinary complaint sent by speed ad post-After 30 days RTI appln-If no reply in 35 days of mailing file first appeal under RTI -If no action police complaint-meanwhile if first appeal does not work in 45 days of mailing file second appeal under RTI with AP SIC -if no action Court. Since AP has not prescribed formats, U can use Central Govt formats with some changes to suit AP. They are available in my blogs.

With due respect to jps50's advice, I feel in land matters the earlier you take legal action the better. Atleast my personal experience is that. You may follow RIT simultaneously. |

In a way Dr. Prashant is right. However I have suggested procedure which Mr. Srinivas can follow from Mumbai. He cannot frequently visit V'patnam and without personal follow-up with police, they do not move and usually collude with local party. This can be last resort. Court matters can be followed by a local advocate at V'patnam.
